Amparo for Dr Mireles Valverde

Translated for Borderland Beat from a Zetatijuana article by Otis B Fly-Wheel

Judge resets procedure for founder of the Auto Defensas and three co-defendants.

Reporter: Luis Carlos Sainz Martinez

The First Unitary Tribunal residing in the City of Morelia granted the defence and protection of Justice (Amparo) of the Union, to the ex leader and founder of the Auto Defensas Jose Manuel Mireles Valverde of Michoacan and three co-defendants, informed Judicial sources to ZETA.

The resolution is to the effect that the Judge of the Second Unitary Court to declare void the same Circuit detention order confirmed on October 14th last year against the defendants and issued a new ruling that the violation of their fundamental rights are corrected.

The Amparo does not establish that the plaintiffs should be released and can not be executed immediately, as the Public Prosecutor has the right to appeal the decision.

As well as Jose Mireles, Javier Reyes Magana, Salvador Mendoza Garcia and Gerado Lopez Casillas, receive the amparo, all those detained by Military on 27th of June of 2014 in the Town of Lazaro Cardenas, Michoacan presumably for drugs and firearms.

The defendants were interned in a Federal Criminal Prison and were put at the disposition of a Judge of the Fifth District in the State of Michoacan, residing in Uruapan, who ordered their formal arrest in the criminal case 137/2014. On October 14th the verdict was confirmed by the Court of Appeal.

Mireles and his co-defendants face charges of possession of a firearm for exclusive use by the Armed Forces, as well as crimes against health in respect of drug dealing, with the variation of simple possession of Marijuana and Cocaine.

The resolution of the Amparo shall be notified to the Plaintiffs in the Prison where they are currently being held, Mireles in CEFERSO No.11 in Hermosillo, Sonora, Reyes, Mendoza and Lopez in CEFERESO No.4 in El Rincon, Nayarit.

Former members of the Michoacan Auto Defensas expected the Amparo would be granted and that their release from Prison would be immediate, but they will have to wait for a reassessment of the Court Hearing of his case, as soon as the Judgement Guarantee is firm.

    1. 8:58 stay jaded, but stay home...there is no reason to keep Innocent people in prison just because of some puss pains like you...
You could dedicate all your strenghts to bitching about rearresting the perps that have been released instead of protesting about releasing Dr Mireles

    2. 9:51 who's complaining about his release? who's bitching? all i see is an attempt at gallows humor. It was obviously over your rabid little head.

    3. I think this has happened since the public release of his Judicial records online. Someone has looked at that, or its just a huge coincidence that just a week or two after the release of his records, suddenly an amparo appears. don't have to be Einstein to put two and two together. Chivis knew this would happen, we discussed it in the comments section of my post on the release of his records.

Of course you are entitled to your opinion, and im happy you posted even if I don't agree with any part of what you posted.

  4. The fact that Dr. Mireles remains in prison is an insult to justice everywhere.
The Mexican Government as a whole is a failed one.
And it appears that most Mexicans do not give a damn about Dr. Mireles.
And where are the Human Rights Commissions, both the national commission in Mexico and the UN Commission?
    Paper tigers.
    Forgotten.

  5. Integrity? this is a show for the publiccreating a facade that something is happening when nothing is happening at all other than a man languishing in jail in the hopes that somehow he dies in a manner that is not suspicious.

  7. Mirales is going to get released soon, not because they want to release him but because they know he is honest man.

    1. I think they were always going to release him, what the Government wanted was to totally dismantle the AD before they release him. They wanted to get him out of the way so they government could oversee the smooth transition of the removal of CT and the installation of the better paying CJNG.

    2. Otis, I certainly agree with your perception of Dr. Mireles. I only have one disagreement with what you said.
I don't know how many stories and commentaries I have read that talk about the high level of distrust of the government, the large majority who don't think EPN is doing a good job, yet PRI still maintains a solid lead in the polls. The explanation they usually give is that the people do like any of the political parties and do not trust any of them. They (the commentators) say the people feel like there is no reason not to vote for PRI because everyone else is just as corrupt. They say PRI will likely maintain their control because "a man of the people" has not risen up and come to the forefront. I think that man could be that man that could unite the people all across the country.
I think that is what PRI feared about Dr. Mireles and why they put him in prison, not over the desire to bust up and destroy the AUDs. It was much bigger than that.
It can and does happen in the real world - not just in fairy tales or on TV or in the movies, or going back to 150+ years to Abe Lincoln. Because of space limitations I can't put much on here, but Google the tiny country of Uruguay and Jose Mujica, a communist gorilla fighter that became President at age 74. We all know some about Nelson Mandela. They are extraordinary men and I think Dr. Mireles is their equal. His country needs him and I think and hope he will respond.

    3. I used to think Dr. Mireles wouldn't be released until after the summer mid-term elections, for fear of his ability to rally the masses against Mexico's shitty ruling government.

It's still premature, but maybe this is happening now because the campaigns have officially started, so it's too late for Dr. Mireles to be put forward as a candidate for elected office.

That was the the great fear, apparently.

But there's still 2018 to look forward to ...

    1. Def not forgotten, anywhere in the world he is now an Icon of everything that is noble in standing up to oppression and corruption. People will be talking about him long after all of us are dead and forgotten.

No doubt he will go down in Mexican history as a hero, he restored the pride and removed fear for a lot of people in Michoacán. He sparked a nationwide campaign of indignation of impunity, that carries on with the disappeared 43 campaign. He has massive respect world wide and he rightly deserves it.

Men of his calibre are very few and far between.

  9. Thank You Otis B Fly-Wheel. As a gringo American I appreciate your insight into this conspiracy within a conspiracy. I pray for Dr. Mireles good health and release in the near future. I've followed your and others coverage with great interest as I warn my fellow citizens north of the border that the cartels are already here and expanding. Sadly our reporters are either ignorant or being guided by our own governments corruption and denial of reality.

  10. I wish Dr Mireles good health above all. The plane crash, the arrest and his diabetes - more than most people experience in a lifetime. My head says, Doc you've done more than anyone could, retire gracefully and enjoy some kind of peaceful life. But my heart says re-ignite the spirit of the autodefensas Feb 2013 - god knows its needed more than ever. There are still people around with you - Hipolito, Shimei Verdia, Jorge Vazquez to name but a few.

  13. They believed he was planning for a revolution, which would be considered treason against the nation and state. A revolution even within the state would cause a national uproar. The man had a great support from the people which makes the idea not so far fetched. He was being viewed as an important vigilant, he was a face a face that could create a movement. So the government had to stop and seal the bottle cap before the whole the whole nation was close to revolting. That is one reason why they are sticking it hard to him.
But don't take my word for just what I heard.

On the other hand the AD also showed the incompetence of the Mexican government. They showed that if the government won't make a change they will. It was a smart move on by the PRI incarcerate the people's main hope, diminish the movement, and push the farce that they are fighting hard against organized crime. Display to the world their government is not incompetent and can and will erase the evil(or just the well known faces of it). The Cartels use the same tactics when trying to gain approval of the people. You can see it in their mantas claiming to remove the bad guys; the thieves, the corrupt, and kidnappers. PRI took advantage of what Mireles and the AutoDefensas had already started to claim the accomplishments and reap the rewards.
