"CJNG Cartel", High-Ranking Mexican Leader Arrested on Charges of International Drug Trafficking and Money Laundering After Faking Own Death to Live in California Under Assumed Identity

A federal court in the Central District of California unsealed a criminal complaint yesterday charging Cristian Fernando Gutierrez-Ochoa — a high-ranking member of the Cártel de Jalisco Nueva Generación (CJNG) and the son-in-law of the CJNG’s leader, Nemesio Oseguera Cervantes, also known as El Mencho — with international drug trafficking and money laundering offenses. Gutierrez-Ochoa was arrested in Riverside, California, on Nov. 19.



“The Jalisco Cartel — one of the world’s most violent and prolific drug trafficking organizations — is weaker today because of the tenacious efforts of law enforcement to track down and arrest a cartel leader who allegedly faked his own death and assumed a false identity to evade justice and live a life of luxury in California,” said Deputy Attorney General Lisa Monaco. “As these charges allege, Gutierrez-Ochoa directed the trafficking of lethal narcotics, causing untold destruction in our communities. To those seeking to harm Americans and to profit from their pain, this arrest should serve as a reminder — we will find you and bring you to justice.”

“Over the last decade, Cristian Gutierrez-Ochoa, a close associate of CJNG’s top leader, allegedly directed the importation of tons of methamphetamine and cocaine into the United States and engaged in violence to aid the cartel’s criminal activities,” said Principal Deputy Assistant Attorney General Nicole M. Argentieri, head of the Justice Department’s Criminal Division. “The Criminal Division is committed to disrupting and dismantling Mexican drug trafficking organizations. Tuesday's arrest sends a powerful message to cartel leadership: we will work tirelessly with our domestic and international law enforcement partners to hold them accountable.”

“Defeating the two cartels responsible for the deadly drug crisis in the United States is the Drug Enforcement Administration (DEA)’s top operational priority, and with the arrest of Cristian Fernando Gutierrez-Ochoa, we are much closer,” said DEA Administrator Anne Milgram. “We allege that Gutierrez-Ochoa, a high-ranking member of the CJNG and the son-in-law of El Mencho, conspired to import thousands of kilograms of cocaine and methamphetamine into the United States on behalf of the Jalisco Cartel. The Jalisco Cartel is responsible for unprecedented violence in Mexico and helping to fuel the deadly drug crisis in the United States. The DEA is relentlessly committed to defeating the Jalisco Cartel, and we will exhaust every tool in the justice system to fight back, to save American lives, and to bring this cartel to justice.”

According to court documents, Gutierrez-Ochoa, 37, is alleged to have started working for the CJNG, one of the most violent drug cartels in Mexico, in around 2014, and to have personally coordinated the transportation and distribution of approximately 40,000 kilograms of methamphetamine and approximately 2,000 kilograms of cocaine in Mexico, all destined for the United States.

Gutierrez-Ochoa allegedly furthered CJNG’s drug trafficking and money laundering activities through violence. In around November 2021, Gutierrez-Ochoa allegedly kidnapped two members of the Mexican Navy in an attempt to secure the release of El Mencho’s wife, who had been arrested by Mexican authorities. After being sought by Mexican authorities, Gutierrez-Ochoa allegedly fled into the United States, assumed a fictitious identity, and resided in a luxury residence in Riverside, California, purchased by CJNG’s money laundering operatives with drug trafficking proceeds.

According to court documents, El Mencho may have assisted Gutierrez-Ochoa in his scheme to fake his own death by telling associates that El Mencho murdered Gutierrez-Ochoa for lying. This helped Gutierrez-Ochoa sneak into the United States to be with El Mencho’s daughter. The Justice Department returned a superseding indictment  against El Mencho in April 2022, charging him with leading a continuing criminal enterprise to manufacture and distribute fentanyl for importation into the United States. The U.S. Department of State is offering a reward of up to $10 million for information leading to his arrest and/or conviction. El Mencho remains a fugitive.

Gutierrez-Ochoa is charged with conspiracy to distribute five kilograms or more of cocaine and 500 grams or more of methamphetamine, knowing, intending, and having reasonable cause to believe that those controlled substances would be unlawfully imported into the United States. Gutierrez-Ochoa is also charged with conspiracy to launder CJNG’s drug trafficking proceeds. If convicted, he faces a mandatory minimum penalty of ten years in prison and a maximum penalty of life in prison on the drug distribution conspiracy charge, and a maximum penalty of 20 years in prison on the money laundering conspiracy charge. A federal district court will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors.

The DEA Los Angeles Field Division is investigating the case.

Trial Attorneys Lernik Begian and Doug Meisel of the Criminal Division’s Narcotic and Dangerous Drug Section are prosecuting the case. The U.S. Attorney’s Office for the Central District of California provided valuable assistance.

This case is part of an Organized Crime Drug Enforcement Task Forces (OCDETF) operation. OCDETF identifies, disrupts, and dismantles the highest-level drug trafficking organizations and other criminal networks that threaten the United States using a prosecutor-led, intelligence-driven, multi-agency approach that leverages the strengths of federal, state, and local enforcement agencies. A complaint is merely an allegation. All defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.

Those days are long gone. A lot of the immigrants of today are far from what they were.     (2/15) En octubre de 2024 la oficina de la DEA en Los Ángeles recibió una Notificación Roja de la Interpol emitida por el Gobierno de México para capturar a Cristian Fernando Gutiérrez Ochoa. La inteligencia mexicana tenía indicios de que estaba viviendo en California. El Departamento de Seguridad Nacional de EE.UU. (DHS) hizo un rastreo de sus bases de datos y confirmó que las fotografías del yerno de El Mencho, enviadas por el gobierno mexicano coincidían con los registros biométricos de un residente de California de nombre Miguel Luis Martínez.
    reconocimiento facial, el gobierno de los Estados Unidos descubrió que Miguel Luis Martínez era el mismo Cristian Fernando Gutiérrez Ochoa. En su investigación, la DEA encontró que el 8 de septiembre de 2023, Martínez utilizó un número de Seguridad Social fraudulento para sacar una licencia de conducción en California, cometiendo robo de identidad. Al parecer, este número de Seguro Social perteneció a una persona fallecida en 1992.
    (4/15) La Notificación Roja de Interpol emitida por el Gobierno de México indicaba que en noviembre de 2021 Gutiérrez Ochoa secuestró a dos elementos de la Marina Mexicana y los tuvo como rehenes para presionar por la liberación de su suegra, Rosalinda González Valencia, arrestada ese lunes 15 de noviembre de 2021 en Zapopan, Jalisco. La Interpol identificó a Gutiérrez Ochoa con el alias de “Guacho”.
    (5/15) Según fuentes confidenciales del Gobierno de Estados Unidos, en 2023 Gutiérrez Ochoa desapareció de México en complicidad de su suegro, El Mencho, quien le ayudó a inventar la historia de su muerte, alegando que él mismo lo había mandado a eliminar por mentiroso y traidor. Pero la verdad, es que le estaba facilitando el escape para que Gutiérrez Ochoa o el “Guacho”, se fuera a vivir cómodamente a California con su esposa, la hija menor del Mencho llamada Laisha Michelle Oseguera González. Los informantes de la DEA aseguraron que en México, Gutiérrez Ochoa también se hacía llamar “El Palomo”. Su ingreso a Estados Unidos aún es un misterio, pero fuentes del gobierno estadounidense presumen que entró clandestinamente por un túnel a través de Tijuana.
    (6/15) Una vez llegó la notificación de Interpol al escritorio de la DEA en Los Ángeles, agentes federales comenzaron las operaciones de vigilancia y de intervención de teléfonos. No fue un trabajo fácil porque, según los oficiales a cargo del caso, el “Guacho” estaba preparado con la tecnología necesaria para identificar cuando sus teléfonos estaban intentando ser intervenidos. La DEA descubrió que la lujosa casa de Riverside, California, donde vivía el “Guacho” con Laisha Michelle, fue comprada en 2023 en efectivo por 1.2 millones de dólares.
    (7/15) La propiedad fue adquirida a nombre de una compañía mexicana con sede en Atotonilco El Alto, Jalisco, llamada Pasión Azul S.A de CV. Los dueños anteriores de la casa y el agente de bienes raíces que realizó la venta, declararon a la DEA que sospecharon desde un inicio que los compradores eran narcotraficantes mexicanos.

(8/15) Pasión Azul S.A de CV, propietaria de la casa donde vive la hija menor del Mencho, hasta hace poco con su esposo, en Riverside California, es una compañía de la industria tequilera que se dedica a prestar servicios agrícolas a grandes productores de tequila. Según su página web tiene clientes como Don Julio de Diageo, Pernod Ricard, Tequila Herradura, Sauza, José Cuervo, Mezcal Amores, entre otras marcas reconocidas. Según registros públicos el fundador y propietario de esta compañía es el Señor Víctor Alfonso Camacho Ortega, quien aparece como representante legal de otras ocho compañías de la industria tequilera.
    (9/15) En su investigación, la DEA encontró que Pasión Azul S.A de CV aplicó a un registro de marca en México en febrero 15 de 2023 y fue aprobada el 6 de junio del mismo año. Agentes encontraron que el representante legal de Pasión Azul S.A de CV tiene registradas a su nombre 53 marcas en México asociadas a bebidas alcohólicas y tequila. Los agentes de la DEA piensan que Pasión Azul S.A. de CV es una compañía más utilizada por el Cártel de Jalisco Nueva Generación para lavar dinero, y que el registro de tantas marcas realizadas a través de un correo electrónico de Hotmail, se hicieron para distraer y confundir a las agencias de investigación mexicanas y estadounidenses.
    (10/15) Otro dato interesante encontrado por los agentes de la DEA es que Laisha Michelle, es propietaria de un café ubicado a unas 20 millas de la mansión donde reside en Riverside, California. La pequeña hija del Mencho es ciudadana estadounidense y al parecer no tiene deudas pendientes con la ley, y por eso no fue arrestada con su esposo. Los agentes de la DEA que monitorearon a Gutiérrez Ochoa, aseguran que vieron varios autos de lujo estacionados en la mansión de Riverside, y el “Guacho” o “El Palomo”, se movilizaba en un BMW. En algunas ocasiones cuando los agentes le hicieron seguimiento, Gutiérrez Ochoa al darse cuenta de que estaba siendo perseguido, realizó maniobras para despistar a los agentes, demostrando que había recibido entrenamiento para escaparse de las autoridades.
    (11/15) Uno de los informantes de la DEA aseguró que trabajó para el Mencho hacia 2010 y 2011 para buscar tierras en Jalisco para cultivar el agave azul para la producción de tequila para distintas compañías, incluida Pasión Azul. El sujeto aseguró que El Mencho utilizó tácticas de extorsión y violencia para sacar del camino a los cultivadores de agave que le competieran a sus compañías. El informante aseguró que el padre de Gutiérrez Ochoa, es un viejo narcotraficante amigo del Mencho llamado Jose Luis Gutierrez Valencia alias “Don Chelo”, arrestado en 2015 en México.
    (12/15) Don Chelo metió a su hijo en el mundo del narcotráfico desde temprana edad, convirtiéndolo en un operador del Mencho, quien años después se convertiría en su suegro. La DEA asegura tener pruebas de que “Guacho” participó en el tráfico de al menos 40 toneladas de metanfetaminas hacia los Estados Unidos y dos toneladas de cocaína, que llegaron en un buque de carga al puerto de Manzanillo, Colima, procedentes de Colombia.
    (13/15) Pero la DEA dice tener más pruebas contra el yerno de El Mencho. Durante el caso criminal de Abigael González Valencia, alias “El Cuini”, cuñado de El Mencho, se intervinieron miles de mensajes de su BlackBerry donde se revelaban los detalles de las operaciones de droga. Algunos de estos mensajes donde se coordinaba el transporte de la mercancía nombraban a un personaje con el alias de “Palomo”, que según la DEA, se trata de Cristian Fernando Gutiérrez

    (14/15) Años después, en una llamada telefónica intervenida a El Mencho, en la cual discute con otro narcotraficante sobre la disputa de algunas plazas en Jalisco como Atemajac, el Mencho menciona a “Guacho” como una persona de toda su confianza que está al lado de él. La DEA asegura que se trata de su yerno Gutiérrez Ochoa.
    (15/15) Según el Departamento de Justicia de los EE.UU., Cristian Fernando Gutiérrez Ochoa tiene 37 años y está casado legalmente con Laisha Michelle Oseguera González. Pero en el registro del Buró de Prisiones (BOP), aparece que el yerno del Mencho tiene 27 años y está detenido en MDC Los Ángeles. Pero al parecer eso es un error, porque de acuerdo a su experiencia y participación durante al menos una década en las operaciones del Cartel de Jalisco Nueva Generación, su edad debe ser 37 años.
