'Don Rodo' resists: Judge suspends extradition of 'El Mencho's' brother to United States.

A federal judge granted a provisional suspension of the extradition of Abraham Oseguera Cervantes, "Don Rodo," after his lawyer filed an injunction.

In addition, the court gave the Ministry of Foreign Affairs (SRE) and other authorities 48 hours to report whether there is an extradition order or if it has already been served.

With this injunction, "Don Rodo" is resisting extradition to the United States. He is trying to avoid being subjected to the weight of justice in the neighboring country, where he is accused of leading the Jalisco New Generation Cartel (CJNG).

Abraham Oseguera Cervantes, known as "Don Rodo," was released from prison on April 30, 2024, after a judge decided not to prosecute him due to irregularities in his arrest, which occurred in 2023.

A day later, the Attorney General's Office (FGR) announced that it would appeal against the individuals who allegedly helped Oseguera Cervantes secure his release from the maximum-security prison in Almoloya de Juárez.

The FGR argued that the release of "Don Rodo" was yet another example of the partial and inconsistent judgments of judicial authorities, which should not depend on the decision of a single individual but should be strictly guided by the law, as established in Article 19 of the Constitution.

On April 28 of last year, a judge ordered the immediate release of Abraham Oseguera Cervantes, after determining that there was insufficient evidence to prosecute him for the crimes he was accused of.

The judge explained that several irregularities had occurred during the detention of "El Mencho's" brother. Oseguera was first captured on April 21, 2023, by the Armed Forces in the municipality of Autlán de Navarro, Jalisco.

What is "Don Rodo" accused of?
According to information from the Sedena (National Security Forces), Abraham Oseguera belonged to the CJNG (CJNG), where he allegedly held a key position as a logistics and financial operator, and as a perpetrator of violence.

Authorities also accused him of participating in money laundering, drug trafficking, and drug dealing in Jalisco, where he was arrested.

Brother of 'El Mencho' Antonio Oseguera Cervantes 'Tony Montana' asks Washington D.C. judge for more time to negotiate agreement

Antonio Oseguera Cervantes, alias Tony Montana, brother of Nemesio Oseguera "El Mencho," leader of the Jalisco New Generation Cartel (CJNG), asked a federal judge in Washington, D.C., for more time to negotiate a possible plea deal with prosecutors and thus avoid a trial.

In a letter signed by his defense attorney, Frank Pérez, who also defends other drug traffickers such as El Mayo Zambada and the leaders of Los Zetas, the court is asked to postpone the review hearing of the case against Oseguera, which is scheduled for May 2.

Oseguera was one of the 29 drug traffickers expelled by the Mexican government on February 27 without a completed extradition process.

The letter, which was also signed in advance with the prosecutors responsible for the case, states that the option of reaching a settlement that provides a short solution to the case without going to trial is on the table, but that more time is needed to assess the appropriateness of an alternative solution.

Furthermore, both Pérez and the prosecutors explain that they also require more time for the defense to review the evidence that is part of the case. Although it has been available for some time, its volume and quantity require more time to analyze it.

This evidence includes various documents and, as is common in these cases, recordings of communications between drug traffickers or informants. There is also evidence previously submitted by Mexico.


​“The discovery materials provided to date, which include a response under the Mutual Legal Assistance Treaty (MLAT) by the Mexican government and more than 75,000 communications intercepted with judicial authorization, total 17.5 gigabytes,” the letter signed by both parties states.
“The parties also report that more time is needed to review the evidence and evaluate the possibility of a resolution that avoids going to trial,” it stated.

In this context, both Pérez and the prosecutors propose that the judge presiding over the case, Beryl A. Howell, postpone the case review hearing until at least July or a later date in order to conclude the review of evidence and announce a possible settlement.

Since this request is not opposed by either party, it is highly likely that the judge will grant the postponement.

Charges and Connections

Antonio Oseguera Cervantes, a former high-ranking member of the CJNG (Jalisco National Liberation Army), faces two charges for multiple drug trafficking and the illegal use of high-powered weapons.

He also faces potential sentences ranging from 20 years in prison to life imprisonment. At the time, he was also sanctioned and placed on the Treasury Department's list of individuals with criminal activities.

In December 2015, Tony Montana was arrested in Mexico, but irregularities in his arrest led to his release. In 2022, he was recaptured pursuant to an arrest warrant for extradition.

Oseguera is one of several individuals prosecuted in US courts for links to the Jalisco New Generation Cartel. One of the most prominent indictments prior to Tony Montana's case was Rubén Oseguera Cervantes, son of Nemesio Oseguera, who received a life sentence last March.

Nemesio Oseguera Cervantes is also wanted by authorities in Mexico and the United States. There is an offer of up to $15 million for his capture.

Mexico City. A blow to the Jalisco New Generation Cartel (CJNG) and the family of its leader. Federal authorities arrested Abraham Oseguera Cervantes, Don Rodo, brother of Nemesio Oseguera Cervantes, El Mencho, and three other people in the town of Atajeas de Covarrubias, in the state of Jalisco.


In a joint operation, members of the Secretariats of Public Security and Citizen Protection (SSPC), the Mexican Navy (Semar), and National Defense (Defensa), managed to capture Don Rodo, who was found to be in possession of weapons, cash, and doses of drugs.


Authorities reported that Abraham Oseguera is considered “responsible for laundering the money of his brother Nemesio Oseguera, through the purchase of ranches, land, and properties, and he also relied on public notaries from Ciudad Guzmán and Autlán de Navarro Jalisco, to manage the name changes of the owners.”


The Security Cabinet indicated: “it is known that his wife Virginia León Osornio invests illicit money in gold mines in the states of Michoacán and Nayarit, with the aim of increasing the financial assets of her brother-in-law Rubén Oseguera”


The arrest was possible by carrying out intelligence actions that included mobile surveillance, and by detecting El Mencho's brother, “who was accompanied by three other members of the criminal group, who were carrying firearms and to prevent any situation that would put citizens at risk, he was stopped.”


They were all transferred to Mexico City and placed at the disposal of the Specialized Prosecutor's Office for Organized Crime (FEMDO).
