Erick “El 85” Valencia Salazar is Granted an Amparo Against His Immediate Extradition to the US

The appeal for the protection of justice was promoted in favor of Érick Valencia Salazar.

A judge granted that Erick Valencia Salazar, El 85, a co-founder of the Jalisco New Generation Cartel (CJNG), is not to be immediately extradited to the United States, where he is wanted for drug trafficking crimes.

The judicial authority granted the outright suspension in the Amparo promoted this September 5, after the recapture of the alleged criminal leader carried out by the Secretary of National Defense (Sedena) in Tapalpa, Jalisco. According to the judicial records, the promoter claimed that El 85 is insured outside the procedure, is incommunicado, has suffered mistreatment, and would even be a victim of forced disappearance.

The appeal was filed by Florinda Salazar Gutiérrez, who claimed custodial acts and, specifically, the extradition order for Valencia Salazar, who had been released from prison in 2017.

“Based on article 160 of the Amparo Law, the outright suspension is decreed so that the extradition order is not executed and the complainants remain in the place where they are available to this court of law. amparo, only in what refers to their personal freedom," states the agreement.

The judge ordered that any violation of their Human Rights cease, regardless of whether the promoter ratifies the Amparo. In addition, 85 and the two subjects with whom he was detained are made available to ministerial authorities or the corresponding judge to determine their legal status.

If the arrest warrant was completed by authorities other than members of the prosecution and if flagrante delicto or urgency of capture is not justified, with a prior pronouncement by the judge, those involved could be released. But legal justifications must also be proven to retain Valencia Salazar.

Now it is up to the Attorney General's Office (FGR) and Sedena to submit reports within the next 24 hours to express whether the act claimed against the detainees is true and if they consider that the appeal in question should be dismissed. If they do not meet the requirement, they would be sanctioned with days of the current minimum wage.



Because El 85 and his accomplices, Cristian Alberto "N" and José Luis "N", are in FGR facilities in Mexico City, a judge in the capital will have to commission personnel to be in charge of locating the detained to notify them of the benefit obtained, verify their physical integrity, that they are processed under the legal framework, the authority that has them protected, in addition, that it be verified where, when and why they were detained.

In addition to this, one more actuary will have to go to the Fifteenth Military Zone based in Zapopan to inform those responsible that the insured ringleader cannot be extradited. Presumably, soldiers of this affiliation were the ones who managed to recapture the founder of the CJNG.

Florinda Salazar Gutiérrez, who filed the appeal in a court in Jalisco, added that Valencia Salazar went to Tapalpa to spend a few days off. It is not specified when or to what precise point, but the municipality is attractive because of the Valley of Enigmas, a site of giant rocks that seem to come out of fantasy stories. 

"The promoter pointed out that the aforementioned complainant moved to the municipality of Tapalpa to enjoy vacations," specified the agreement that ratifies the suspension to prevent 85 from being extradited immediately. The judicial record pointed out that Salazar Gutiérrez managed to access testimonies of people who witnessed the arrest last Sunday morning. For this reason, he assured that the co-founder of the CJNG was deprived of liberty by elements of the Ministry of National Defense (Sedena).

The Amparo suggests that El 85 was kidnapped by military agents in a supposedly illegal operation, hence it is noted that there was no compliance with an arrest warrant with the support of judicial authorities. For now, a Jalisco judge ordered the responsible military authorities to immediately clarify how they achieved the arrest. For example, if it was indeed when the objective was going to vacation, where was he transferred and under what support and file is the insurance in Tapalpa supported.

He may have been mostly laying low since he was released from prison, and it is questionable what role he played in his post prison career, if any, but he is responsible for a lot of damage in his preprison life that he has yet to be held account for. When Uncle Sam wants someone, it's pretty hard to hide. John Gotti completed his life sentence, Chapo most likely will complete his, and unless old 85 sings a pretty good tune, he will complete his sentence as well. Let the singing contest begin.
