Héctor "El Güero" Palma Released From Prison and Re-Arrested Minutes Later

"Morogris" for Borderland Beat

Sinaloa Cartel founding member Hector "El Güero" Palma was released from prison on Tuesday morning after he was absolved of his organized crime charges over the weekend.

However, he was re-arrested outside the penitentiary and taken to Mexico City due to an outstanding arrest warrant. The details of this new arrest warrant were not revealed by press time.

Palma left the Federal Social Readaptation Center No. 1 ("Altiplano") under heavy security. Over 30 members from the National Guard (GN) and the Attorney General's Office (FGR) helped during his re-arrest and transfer to Mexico City.

It has now been revealed why Palma was absolved. Mexican media outlets have explained that the FGR did not sufficiently prove that Palma was responsible for leading drug trafficking operations from 1989 to 1995, the year he was captured.

Victor Francisco Chavez Romero, the judge from Jalisco who absolved Palma, explained that there were several contradictions in the witnesses who testified against Palma. In addition, he said that the witnesses were not properly vetted and that their testimonies were extracted from other criminal investigations and included in Palma's without proper evaluation.

One of the testimonies said that Palma was involved in drug trafficking while in prison. He was accused of stealing close to half a ton of cocaine from the FGR headquarters in San Luis Rio Colorado, Sonora, back in 21 May 1997. The person who stole the drugs followed the orders of Eduardo Gastélum Barraza, alias "El Pony", "El Caballito", and/or "M-11", a man under Palma's organization.

The judge said that this 1997 drug theft case was used as evidence for Palma's conviction, but he explained that the event did not prove Palma was responsible.

"The evidence provided by FGR investigators did not to fully prove the existence of a crime. It only proves the existence of the Sinaloa Cartel but not of Palma's involvement with them", the judge said.

It is worth nothing that Palma was under investigation for the murder of two police officers in Nayarit, but investigators confirmed that this investigation was still its preliminary stages (Spanish: desahogo judicial). This means the prosecution may still need to gather more evidences against Palma and vet them with a judge prior to issuing a formal arrest warrant. It is unclear if this investigation was the one that led to his re-apprehension.

  5. FGR messing up again. No wonder all these capos are released years later. Mexico needs some big changes in the way they structure cases, investigations, etc

    1. They need big changes in every aspect of society. Fundamental changes. the drug trafficking business gets in the way of change though, without drugs no doubt there would be massive improvements

    2. 1:20 PM Without drugs things would still be the same they would move on to whatever else makes money. The US is filled to the brim in drugs but somehow it manages to function.

The roots cause of Mexico's problems is the institutionalized corruption that exists. Even the lowest of bums with the ability to pay a few thousands pesos is able to get away with anything. Those with more money can get anything they want in Mexico.

    1. It's not Mayo of RCQ. It's political pressure. People are making a big deal about Guero being let go, blaming AMLO's government for letting go of Narcos, it's election season in Mexico folks. He was rearrested, and this is just my speculation, based on politics. Guero has been out of the game for too long to have that kind of pull to start wars, he was in US custody until he completed his sentence and was deported back to Mexico. He is 80, keeping him in prison now just costing money. If Guero was an anonymous narco he would've been let go, but because he is famous and people won't let you go of your past they are keeping him locked up.

  15. Picture Osiel getting out and continuing where he left off?? Ruling CDG with an iron fist & absorbing all the factions into one like how it use to be.

I mean RCQ wields some power after getting out. I am just curious to see if someone will come out and go back to the top like they were even after being gone for decades. That would be impressive and show of power.

    1. Osiel has too many enemies & too many splintered factions in CDG/Z’s... RCQ never left the game & had family members continuing the family business... Guero prob has money stashed away but is also prob very much in danger & has little/no influence anymore in the game... not to say he prob still has some old school connects/contacts...

    1. Sad to see all of you pathetic losers defending a murderer from a cartel. They are the scummiest pieces of subhuman trash on the planet and deserve to be purged for the thousands of innocent lives they've ruined. Supporting someone like Guero is siding with the scum who plague Mexico. You're all scum.

  18. The pgr stole a load of 700 kilos after they took money to let it go through. El caballo Gastélum from guamuchil sin. Took a team of over 50 men and took over the pgr in San Luis and took back the 700 kilos. It had nothing to do with guero. El caballo got killed years later this was all gente de guamuchil
