El Chapo Case Supreme Court dismisses case to return Chapo to Mexico

Throw Away for Borderland Beat from Milenio

The Supreme Court of Justice of the Nation (SCJN) dismissed a case promoted by the [Mexican] defense of capo Joaquín "El Chapo" Guzmán , where which they sought to compel the federal government to request the repatriation of the leader of the Sinaloa cartel , imprisoned in the U.S.

In demand for guarantees, the defense of El Chapo again argued that his client was extradited to the United States and delivered to the District Court of New York unlawfully.

In February, the First Chamber of the Court had already dismissed two claims. In these appeals, the lawyers of the capo claimed that the Mexican government surrendered El Chapo to the New York Court, when they did not request surrender.

On January 19, 2017, one day before the beginning of the Donald Trump era as president of the United States, El Chapo was extradited.

At the Ciudad Juárez International Airport, El Chapo boarded an airplane of the Mexican Air Force that moved him to New York , where he arrived around 9:00 pm and where he was received by DEA agents.

The then Attorney General of the Republic handed over the capo because the Fifth Collegiate Court in Criminal Matters of Mexico City confirmed the decision of a federal judge who refused to grant protection against extradition.

  1. Can't blame his willingness to return to Mexico. With a new president and this alliance to Sinaloa he will be released.
Nevertheless, the US government will not stoop to this injustice.
Quite sure his only lifeline would be a new trial.

    1. I think you need to read the original Spanish article for you to understand.
It was the Mexican Supreme Court the ones who told Chapós lawyers they will not ask for Chapo to come back to Mexico.
In other words, is not the Mexican government asking for chapos return to Mexico to the USA government. It is Chapos lawyers asking the Mexican government to ask the US for Chapo Guzman.

  3. Sorry once the US courts found him guilty as charged, you can't have him back, just because Chapos mother, said she wants her son back, don't mean the US will do it.

  7. Wouldn't have mattered anyway. According to United States v. Alvarez-Machain (the doctor who may have been involved in Kiki Camerena's murder) the United States federal government doesn't care how a person finds their way into American custody.

    1. Dr Alvarez Machain was returned to Mexico and was never prosecuted again, kidnapping to deliver him to the US did not work.

Honduran Juan Ramon Matta Ballesteros is the only CIA associate who did prison on the US for murdering Kiki Camarena suppossably still in prison, but his main buddy Felix Ismael Rodriguez Mendigutia has never even been interrogated...
Another Mexican involved died in prison, not worth remembering who

Ejemplos, Carlos Salinas y Enrique Peña Nieto.
