Court Rules Against the Extradition of CJNG Leader Abigael González Valencia

"MX" for Borderland Beat

Background: Abigael González Valencia (alias "El Cuini"), one of original members of the Jalisco New Generation Cartel (CJNG) and its financial branch Los Cuinis, was arrested in February 2015 in Puerto Vallarta. He is the brother-in-law of Nemesio Oseguera Cervantes (alias "El Mencho"), Mexico's most-wanted drug lord. The U.S. government has tried to extradite him for drug trafficking and money laundering charges since El Cuini was arrested, but his defense team has issued several motions to delay and/or reject his transfer.

A federal court gave Abigael González Valencia, "El Cuini", a breathing space that will allow him to extend his legal battle to prevent his extradition to the United States for another year. The Sixth Criminal Collegiate Court granted a writ of amparo (similar to a habeas corpus) in El Cuini's favor and obliged Mexico's Ministry of Foreign Affairs to analyze the proceedings against him for crimes committed in Mexico and, based on that, to assess whether or not to defer his delivery to the U.S.

Regardless of whether Mexico's Secretariat of Foreign Affairs (SRE). reorders his extradition, the ruling will lengthen the eventual delivery of the alleged drug trafficker, since his legal team can promote a new writ of amparo that would be resolved in at least one year. The U.S. seeks to extradite El Cuini because he faces drug trafficking, organized crime, and money laundering charges from an indictment of the U.S. District Court for the District of Columbia. He's also been linked to the Revolutionary Armed Forces of Colombia (FARC).

On October 11, 2016, the Sixteenth District Court of Federal Criminal Proceedings in Mexico City stated that El Cuini should be extradited, but left it up to SRE on whether or not the extradition should be deferred. A deferred extradition, established in Article 15 of the Extradition Treaty between Mexico and the United States, is expected when the individual claimed is subject to other legal proceedings in progress or is serving a sentence in Mexico.

On December 21, 2016, the SRE granted his extradition and stated that the criminal proceedings he had pending in Mexico were not an impediment to deliver him to the U.S. However, a court rejected this motion because the SRE did not mention the deferral process in his extradition request nor mentioned the charges he was facing in Mexico (specifically in the states of Jalisco and Chiapas).

In order for the plaintiff to file a new extradition process against El Cuini, they have to collect a copies of his arrest warrant / preventative detention order issued against him in Jalisco and Chiapas. Then the SRE has to include language of the deferral process and the charges he faces in Mexico in the extradition request. Once this is processed, El Cuini's defense could challenge it via a writ of amparo.

    2. Extradition is basically Mexico bending over for the Yankees, they always wanna bring drug lords over here but what about the bankers in the US that launder the money? They should be sent to Supermax too along side top heads of the CIA and DEA.Might as well give life sentences to people that use drugs too.The US prison is a joke, they like to lock people up not because they’re the good guys but because they get money from those prisons. The real scumbags are free.

    3. Should we send those bankers to Mexico

    4. Ignorant comments.
Extradition is the only means of justice to Mexico's citizens. With all those killings which are attributed from their organization. How else will justice be served. Mexico lacks balls to enforce any justice. Rather, enriching those justices, politicians and police officers.
Ridiculous comments who wish to see their country in ruins.

I would not be opposed to closing the border if Mexico can't get their shit together. Like to see the comments of financial struggles from such an implementation.

    5. 9:06am; USA doesn’t want anything badly except citizens to continue growing the fastest growing industry over the last 20 years; falsely titled the war against drugs.
Your politicians, militar, defense contractors, private arms industry, private prisons, your banking system, luxury real estate, drug and hundreds of thousands of informal workers in major cities and small depend on illegal revenue as a livelihood. Your own DEA spent tens of millions to make a case against Cardinal Health, McKesson, AmerisourceBergen for doing what any non-multi billion company would be in prison for life for; but like your banking systems fraud was allowed to go without one person prosecuted these three worlds biggest USA BASED cartels have police and político protection even while they have each killed more USA citizens than all Mexican cartels together over the last 10 years. They also “donate” more to politicians than what Chapo, Arturo, and Amado “bribed” together for their rights to distribute across the USA using their licensed drug dealers that are protected by the American Medical Associacion.

    6. Funny to read all these comments about how 'murica does it right. Chupeta is going to see freedom after admitting that he killed 150 people... Many other examples of capos that "donated" $ to lighten their sentence. No morals in the US, just business... 'Murican sheople being sheople .

    7. 11:34 You nailed it. Mexico is awash in greedy politicians who are compadres with all the criminals. The best thing is to let USA handle the real justice

    8. 11:34 What an ignorant and ill informed statement. Have you heard of Jeffrey Skilling? I saw him and his wife enjoying steaks at Ruth Chris steakhouse in Houston last Friday night. Yes America is the home of justice. Lol. Just like Mexico there is a direct correlation with how much money one spends on a defense and how much time they do so take your thick rose colored glasses off.

  3. Not to sound like one of those narco nuthuggers but it's good to see that the US govt won't get to squeeze this capo, who I hear may have been the biggest one of them all... Juicing narcos has been great business for the US, I hope Mexico can do the same now that the govt appears to act for the benefit of the people.

    1. That's exactly what I am thinking of. The further to extradition means more time to get off either by paying more to Mexico's government or escape.
