El Chapo Trial Day 2- EPN and Fox were on the payroll"

Chivis Martinez Borderland Beat

Today prosecutors requested judge Cogan throw out the opening statement of the defense.  Reasons given is that defense strayed from speaking solely about “evidence that will be presented in trial” Judge Cogan reprimanded the defense without throwing out opening statements of the defense.

A point of contention was that Presidents of Mexico were on the cartel payroll.

The prosecution filed a motion overnight demanding that judge Brian M. Cogan strike the entire statement from the record, calling it “rife with impropriety” and based on “blatantly inadmissible hearsay.”  [read that filing below]

Said Lichtman; “This is a case that will require you to dismiss what you were taught to believe in about the way governments work and how they behave he continued  “This is a case which will require you to open your minds to the possibility that government officials at the very highest level can be bribed, can conspire to commit horrible crimes; that American law enforcement agents can also be crooked.”

This is supposed to be Chapo waving to Emma
“While the world focuses on this mythical Chapo figure, the world is not focusing on Mayo Zambada,” “That’s thanks to “hundreds of millions of dollars” in bribes paid to Enrique Peña Nieto, the current president of Mexico, and his predecessor Vicente Fox.”

Mr Lichtman said that Zambada had been left free because he "bribes the entire government of Mexico including up to the very top, the current president of Mexico," Enrique Pena Nieto.

Judge Cogan said defense went "far afield of direct or circumstantial proof."

Reportedly, Fox quickly tweeted out his innocence.

The office of President Enrique Pena Nieto called the allegations "completely false and defamatory." While former President Felipe Calderon dismissed them as "absolutely false and reckless."

Lichtman also asserted that Zambada’s brother and two sons were cooperating with prosecutors, and suggested the focus on Guzman might be to distract from Zambada.

Some of his objections defense presented in opening arguments:
(1) was out to get the defendant because of his status as a"mythical" figure;
(2)had chosen to prosecute the defendant ratherthan other drug traffickers, specifically, his codefendant IsmaelZambada Garcia; and
(3) had engaged in outrageous conductbecause it was so desperate to prosecute the defendant.
A few cooperative witnesses named by defense below from Mica:
  • Miguel Angel Martinez, an ex-Mexican trafficker who he said had a 4-gram per day cocaine habit
  • Alex Cifuentes, a Colombian narco who worked w/ the Medellin cartel
  • Jorge Cifuentes, another Colombian trafficker
  • Damaso Lopez, El Chapo's former right-hand man who helped him escape from prison
  • Cesar Gastellum, another El Chapo lieutenant who allegedly paid bribes to Honduran government.
The complete list has not been made public, but I look for at least one woman to give testimony.  Guadalupe Valencia.  The money lady, who is schedule to have her change of plea hearing at months end.

Today if time allows will be testimony from two cooperative witnesses.

    2. El Mayonaise is the snitch. I knew it from the start when Vincente Zambada got busted. Shit started falling pretty fast, El Chino Antrax going down, etc. I really wish that they would broadcast the trail on television. There's going to be some pretty insane leaks on US and Mx Govt involvement. Lots of powerful people and institutions like CIA and DEA protection. Such a shame because USA is that crooked, the entire case file is going to be blacked out.

    3. Damaso snitched, he was the informant who started the Beltran war with Chapo, then that war caused the twins to go snitch to save their skin when they caught in the middle. Damaso caused a lot of grief.

    1. Not everyone has a price.Lots, yes and in certain countries more so but not everyone. If American government officials implicated they will shut it down for the public like Zambada's son for national security reasons which is maybe what they want to do.I think they won't to plant doubt about who runs the show but if by chance chapo gets off and sent back to Mexico he will get whacked. That's my speculation anyway.

    3. Everybody and I mean everybody has a price… Some may have a price much much higher than others… But billions of dollars can corrupt any human being.

    4. 12:10 like 5:11 said not everyone has a price. You believe that because you obviously think everyone is driven by money or riches but not every is...There are plenty of things i wouldnt do for Billions and i am not alone.i personally wouldn't murder anyone for all the money in existence..Now if i had to accept a bribe or move drugs across the border or give some info to a cartel because of threats to my family i might do it..But believe me,their are ppl who prefer a simple life.

    6. Every one has its price, no question about it. A single situation might provoke to sell your family. You can say that you are a model of honesty but truth is, you've never come to face such a situation. I wish this weren't true but, it is. Hope you never face this.

  3. Animo Patron!! Use your Psychological Operations training. El Sr Chapo has been trained to undergo any type of torture or waterboarding techniques. He was trained by a Mossad Interrogation Specialist and a SAS operative that was imprisoned in Chechnya. He has studied Tai Chi and Yoga and Buddhist mind concentration techniques which is why his time in jail does not affect him.
We await for you here in CDS headquarters in Culiacan Sinaloa.

  5. Something tells me Chapos sons and brothers will flip on Mayo and Side with El Mencho. It looks like Los Zambadas are the actuall snitches of this Novela. Once Chapo realized they are going to Snitch on him he might aswell self snitch and snitch on who is snitching on him. Damaso Lopez most likley kidnapped Chapos sons on the orders of Mayo and CJNG were the ones that ended up getting them relesesd. The purpose for this was to distract from the fact that El Mayos sons were going to cooperate with the Feds and the person that turned El Chapo in was Damaso but the orders came from el Mayo. He wants his kids to get out of the Pen before they turn 50. You can tell Mayo could careless if others fall as long as his kids get out.

    2. On the contrary.
Chapo and Mayo assured arraignments for this trial to go the way it is. Mayo will protect his kids and have a continuous interest in ongoing operations.
Chapo was doomed when extradited to the US. This clearly evident.
The price to pay when in this business.

The good news is; the full extent of Mexican government officials along with US agents under the payroll. Like I stated before;bribes and influential government officials are a must to operate such an empire. Which clearly is demonstrated here.

Can only laugh at the thought of Vincente Fox denying such accusations.
I always said he is a Hypocrite.
America should revolt his Visa for being a crook. Along with his middle finger pointing Twitter towards securing Americas border.

Money is the root of all evil in the end.

  9. Fox was on the payroll more than obvious to the average mind. Fox takes the throne and immediatly declares war on the AFO. Chapo's biggest and most powerful rival enemy. Chapo escapes prison in 2001. The Arellano Felix brothers are immediately put on the defcon 1 list and hunted like wild game by the MX and US governments. All the AFO's top brass is decimated by this point. Fox sends troops to Tijuana to finish eradicating and put the final lethal blow to the Tijuana Cartel. Benjamin gets nabbed a year later. El Doctor and El Tigrillo are not a threat to nobody so they get the leftovers of their local business. Now with CAF on its knees, The coast is clear for Chapo.

    1. I don't believe all of the presidents were directly on the payroll or paid off. However, I believe those movers and shakers of administrations are/were. incl military, pgr etc.

If there are presidents who are culpable i would guess FOX would be front and center. The faux Texan and his wife with her bogus charities and coca cola payoffs carry a ton of baggage filled with personal corruption. I think EPN played loose and free with tax payers money but I am not willing to say for sure he is narco culpable. Calderon either. But surely high ups in their admins were. anyway my two cents....

  13. Here's a delusional theory regarding Mayo...something strange about his brother and probably son dropping dime on him like that in open court...Chapo is never leaving US unless dead. What if Mayo is dead????? And Azul??? Everyone can blame them for everything, and with the exception of Chapo, they all get relatively lighter sentences and WITSEC...The kids of Chapo and Mayo should get outta Mexico to a non extradition country, hire Capo's to run biz and just stay out of the light.....Just a theory

    2. Interesting comment Granderojo.

Bottom line was cheapo was done from the moment extradited to US soil. It's only logical to keep his sons in business and alive with Mayo's help.

It's not like he (chapo) was ever going to get out of jail anytime soon. He was a target to US administration long ago.

  21. The drama the big show… Put on for the public, when those of us who know the truth that regardless of whether El Chapo is convicted and in prison or is set free it doesn’t matter. If the objective here is to stop drugs and drug traffickers this will do nothing but make the situation worse there are 1000 El Chapo’s waiting to take his place and the money and the drugs will continue to flow

    1. U are so correct.
America's appetite along with global consumption will never end. Added with the riches from all business sectors who reap the rewards.

Imagine a world where drugs offenses did not exist?
Imagine the financial impact this will have on employment rate and sales?

This drug epidemic problem is also a financial benefit to many.
