El Chapo's defense: "Mayo Zambada is the real leader of Sinaloa Cartel"

After two jurors were dismissed today and their replacements selected, opening statements began in the afternoon in the trial of Joaquín El Chapo Guzmán.

The U.S. prosecutors went first with their opening statement.  They gave an overview of the charges that brought El Chapo to trial including his global drug trafficking operation, and multiple murder conspiracies. 

Missing were murder charges that the government quietly dropped over the summer.

When it was the turn of the defense, we were able to get a peek into the defense plan of El Chapo and their reply to the charges of the U.S. and it is one we’ve heard before…..that it is El Mayo Zambada that is the real leader of the Sinaloa Cartel, and El Chapo was a figurehead. 

A few months ago, in July, I wrote an article,  [link here for article]   About a document that was supposed to be redacted, but with a couple of moves one could see under the black out. 
The document, which is a letter of reply, essentially named 9 pieces of evidence of 41 in the hands of the government.  The government disclosed as having this evidence, without producing additional context, with respect to the potential exculpatory evidence, indicating El Chapo was not the top leader of the Sinaloa Cartel, and never had been. This is one of the charges against him.   Only a couple of months before trial, the defense were made aware that such evidence existed.

It appears this, at least in part, is what El Chapo is planning to use as a defense.

On a side note, not long after this happened, I was doing research on CJNG when I stumbled across a 2007 article in Proceso. The article was about Los Cuinis and CJNG, but within the article was this paragraph:

Guzman Loera was only an emblematic figure whose function, aside from still taking part in drug trafficking, is the distraction of authorities. According to data from the PGR and some journalistic articles, El Chapo Guzman has decided to leave his hiding spots and has started to frequent restaurants and public places: a little over a year ago the Assistant Attorney General for Special Investigations and Organized Crime (SIEDO) detected him downtown in a city in the state of Durango.
It will be very interesting to see what information the government had regarding this.  Speculation is that it may have come from one or more cooperative witnesses.

The government added 4 cooperative witnesses a couple of weeks ago, which should be a total between 12 and 14. 

After cutting his deal with the government last week, El Mayo’s son is expected to be one of those witnesses, which could be confusing to the jury, after hearing it is Vincente Zambada, son of “the real leader” who is testifying against the man who is accused of being the leader.

The defense hit on the cooperative witnesses during opening statements.  They assured the jury that these witnesses could not be trusted, as they were all criminals who made deals in exchange for testimony.

That could work in the case of most witnesses; an exception may be the Flores twins, Margarito and Pedro.  The twins provided the government a mountain of evidence, videos, and documents, recorded phone conversations of them and four dozen narcos, with El Chapo taking center stage. 

And we can’t forget the Sean Penn El Chapo video.  In the video El Chapo discusses and admits his drug trafficking. However, previously, the prosecution said they had no plans of using it as evidence and no plans on calling Penn as a witness.


If convicted on most any of the 17 charges, the sentence would amount to a life sentence.  For example, the Kingpin Statute, which means operating a continuing organized criminal enterprise, would be a mandatory life sentence.

Chapo and mencho had a disagreement in colima before chapo got arrested. Chapo tried to muscle in cjng territory and mencho wasn't having it. Colima is still cjng even though cds sends their sicarios on a suicide mission every couple months.

If that's the case, than why would the Sinaloa Cartel invest its resources to pull off a James Bond type movie stunt to spring him out of max security...Chapo is a the logistics and innovative genius AKA El Rapido behind CDS when it comes to moving dope. His organization's business model of efficiency and effectiveness when moving product has been copied by other criminal organizations. No other organization in the world can duplicate its global reach and sphere of influence. Its charismatic leaders were and are living legends in a global stage of criminality.

      actually the real "Rapido" is joaquin guzman. he was given the name back in the 90's when he first came up with the idea of trafficking thru tunnels. he had the ability to cross multi tons thru his tunnels in no time. hence his nickname "el rapido". el nini also goes by el rapido but hes not.the original

      We all know one cannot run a criminal organization without the knowledge and kickbacks to government agencies from all sides.
      Despite Mexico's law of apprehension and extradition of its own government officials. The truth is there for all to see how its run.

      Note; Doubt that any such evidence /aggreements pertaining US officials would be admitted as evidence by US government. Deniability by all governments is a standard protocol.

Beltran Leyva Bros and Nacho Coronel and many other smaller leaders. Chapo was a leader of his own group and did what he wanted. He was also the face of the Sinaloa Cartel. No more no less.

  26. Lame defense, for under the law, all parties to an offense(s) are equally guilty. If I get you to agree to be a getaway driver in a bank robbery, then you are just as guilty of bank robbery as the one who entered the bank with the gun. All things being equal, the gunman did the more aggravating act by doing the stickup, and thus should get more punishment than say the getaway driver or lookout, but it doesn't make the other parties to the offense any less guilty. This is a damage control defense with a challenge to convince the jury that what offenses Mayo actually ordered, controlled, or committed were not reasonably foreseeable by Chapo, and so, he can't be guilty of the more serious allegations.

Mencho punked mayo and it's confirmed in la paz baja California, when he was asking mencho for a truce but mencho kept on killing his crew.   32. Hi Chivis. Thanks for the “Blow by blow” coverage. I remember preparing for trial in cases like this where all your witnesses are crooks. The defense will always attack their credibility and accuse the witness of making a deal with the gov’t in exchange for their testimony.

    As a part of the prosecution team, each witness has to debrief fully, leaving nothing out, as the defense may bring something out that the witness never told the prosecution and damage credibility.

    It will be very interesting to hear the prosecution describe their witnesses and even more so when each witness takes the stand.

    1. Hey Steve! Thanks for weighing in. In this case most of the 14 or so should be discounted. and a few are much more vile than chapo. BUT at least four have solid supporting evidence that will be impossible for the defense to circumvent...

      300k documents alone...

      I always have been under the belief that prosecutors know and rely on an ignorant public when presenting these CW at trial.

  37. Hi Mica. The Arellano’s murdered the Cardinal in their fervor to kill Chapo. Chapo was the target, but I truly believe it was that event that brought Chapo into the limelight. It’s got to be a huge challenge to keep all of the witnesses away from each other as some are enemies. This is gonna be an entertaining trial.

    Chapo is a POS and anyone (Emma) associated with him too. He killed thousands of people. I know our case and cast of cooperators had lots to say about Chapo but I really don’t think the prosecution needs them. Everybody captured or turning themselves in in the last 10 years should be sufficient. Have fun and have a slice of that NY pizza for me.

Then mayo will in the end kill chapos kids and chapos moronic brother will cause even more problems. At some point the government will get mayo since he will be forced to move around more during a "war" with people who knows him and his regular hiding places. Mencho will for sure be killed with the help of America. Then what? No other major cartel left. BLO are nobodies. zetas and cdg are not what they used to be.

Lots of families are involved in the organization that no one knows about and keep to them selfs they also have a massive amount of influence and are very well structured internationally & I do see a blood bath between los chapos and los mayos if they don’t come to an understanding quickly of some sort about what’s going on in court but only time will tell. In every organization someone or a group of people become a “Dropout,” “Snitch” & “Rat” etc. look at one of the oldest syndicates, Sicilian Mafia aka Cosa Nostra, a criminal syndicate filled with countless government informants and the organization is still working and operating tel this very day. Am not comparing CDS to the Cosa Nostra but CDS is a well structured international organization. Like in the California prison system the two main organizations are the eMe and NF they too have “Dropouts” and informants. It’s a sad reality.
