Gov claims conspiracy murder against Sinaloa Cartel "threats", in El Chapo case

The government claims Chapo conspired in the murder of his cousin. Above El Juancho and Guero Bastidas

On July 20th, the United States prosecution team sent a letter to Eduardo Balarezo and William B. Purpura, the defense team for Joaquin El Chapo Guzmán. 

In the communication, the government provided a "bill of particulars" , supposedly specifying the murder victims and dates relating to count one, charging conspiracy to murder individuals whose posed a threat to the Sinaloa Cartel, although he is not charged with any violent acts himself.

The government goes on to state, “The government intends to prove the following murder conspiracies at trial.”

However, the government does not disclose the complete list of specific names of conspiracy victims, or any other information pertinent to the claims, citing “the disclosure would reveal the identity of cooperating witnesses”, which the government has yet to forward to the defense.
Obviously, a defense cannot be developed, or prepared for,  without information such as names, dates, what occurred, of the specific allegations.  

Says Balarezo:
“Under our Constitution, everyone has a right to due process and a fair trial — whether his name is John Smith or Joaquin Guzmán. The government’s actions in withholding evidence make a mockery of that right and deprive Joaquin of the ability to defend himself.”
On July 24th, El Chapo’s defense team filed a motion:

[defense on behalf of Chapo] “respectfully moves this Court for an Order precluding the government from introducing at trial any evidence relating to Violation 85 of Count 1, or alternatively, for a continuance of trial and directing the government to immediately produce evidence relating to Violation 85.”

The communication goes on to list facts in support of the request.  You can read the letter in full below.

In part:

Mr. Guzmán is before this Court on a fourth superseding indictment filed on May 11, 2016, which charges him and codefendant Ismael Zambada Garcia with a laundry list of offenses, including operating a continuing criminal enterprise (Count 1); participating in a wideranging narcotic trafficking conspiracy (Counts 2, 3 and 4); eleven counts of specific acts of distribution of cocaine (Counts 5 through 15); use of a firearm during a drug trafficking crime (Count 16); and conspiracy to launder narcotics proceeds (Count 17).

Although the government has not charged Mr. Guzmán with any violent offenses, it alleges in Count 1 (CCE) that:
The defendants JOAQUIN ARCHIVALDO GUZMAN LOERA and ISMAEL ZAMIBADA GARCIA and other leaders of the Sinaloa Cartel also employed“sicarios,” or hitmen, who carried out hundreds of acts of violence, including murders, assaults, kidnappings, assassinations and acts of torture at the direction of the defendants.Indictment at ¶ 5.

The government wanted 5 days to respond, the judge gave them 5 days.

    6. Looked at Net Flix documentary series "Drug Lords" . Episode 5 is El Chapo . They don't paint a very flattering picture of him . Pretty much my opinion of them all no matter who they are with . Maybe that's why my comments are not taken well on here . I could execute him without a second thought and know the world is a little better for it . In some peoples eyes that makes me as bad as them . I am a gringo from the US . From here I believe the majority of the military in Mexico are doing a hard job and doing it the best they can . They are killing the holey hell out of these cartel fighters . From here it looks like a good thing . Of coarse if he was your son , it was unjust in your opinion . Teach your children well or they wont be with you long .

    7. 10:21We have a much more modern agreement than this one . The new treaty came about while chapo was in prison the forst time . He had his run of the prison and continued to run his organization from inside . ANYTHING he wanted he had . The reason left was because of the extradition treaty .

  18. Hi Chivis. Hope you are well and Happy. Regarding the question of charging someone for murder in Mexico, I can explain it to some extent with my experience. In cartel cases, we usually charge RICO (Racketeering Influenced and Corrupt Organizations Act) or CCE (Continuing Criminal Enterprise). Both are fedeal "Kingpin" statutes with the possible punishment of death or a life sentence. However, if our subject has been arrested in Mexico, we assure the GOM that we won't kill them or lock them up for life if we want them extradited because Mexico does not have those sentences yet.

    In both types of cases, we had to establish that there is a criminal organization, an identified leader and a group of subordinates that commit crimes in furtherance of the organization. Typical crimes are drug trafficking, murder and other violent acts, corruption, money laundering, extortion kidnapping and more. These are conspiracy cases and if you are a member of the organization you are responsible for all crimes they commit. Its "all for one and one for all." The other component of the prosecution are overt acts committed by the organization. These often include murders in Mexico. In all of our cases we included overt acts on both sides of the border for example The Murder of Cardinal Posadas-O'Campo in Guadalajara and The Murder of Luis Valero and Attempted Murder of Jesus Blancornelas. Both events occurred in Mexico but both events had strong ties to the US and Mexico and "affected interstate commerce," a phrase used in both kingpin statute verbiage.

The games the US gov is playing in this case is ridiculous,320,000 pages of documents,1000s of recordings etc,pure hearsay of murders,they take the word of real hands on killers and worse people than chapo and treat it like rock solid evidence.Using that silly video of Chapo(allegedly)interogating someone about Zetas as more evidence of his violence yet there is no violence in the video,its all hearsay treated as fact which will suffice after all the propaganda the US gov has used many times against many different targets.Chapo is no angel and he is likely sailing into the sunset but dont say the US gov upholds truth and justice,it does what it likes when it likes.Why dont they charge Chapo with the death of Tupac and Kennedy ?
