Authorities Deny Legal Protection To the Boss of Bosses; Must Pay 20 Million

A federal judge refused to protect drug trafficker Miguel Ángel Félix Gallardo, El Jefe de Jefes, who sought not to pay 20 million 810 thousand pesos to the families of DEA agent Enrique Camarena Salazar and Mexican pilot Alfredo Zavala Avelar for reparation of the damage after his murder in 1985.

On March 13, 2018, the judge of the criminal case determined that the period of “five days” granted to Félix Gallardo on February 27 of the same year had expired to cover the reparation of the damage imposed in the judgment of 2017.

For this reason, the judge sent a letter to the Decentralized Collection Administration, based in Jalisco "1", to initiate the corresponding coercive economic procedure, that is, to enforce it; He also notified the tax authority that the complainant was an inmate at the Jalisco Police Station for Sentenced Persons.

The capo filed for legal protection, but Luis Miguel Pérez Carranza, secretary acting as judge of the sixth district court of amparo in criminal matters in Jalisco, denied him protection, indicates the public sentence at the end of September of this year.

Félix Gallardo argued that the judge who sentenced him is incompetent to resolve the issue of compliance with the sentence, since this corresponds to a judge for the Execution of Sentences.

However, Luis Miguel Pérez indicated that there is an agreement of the Federal Judicial Council (CJF) that states “in a conclusive way and without a doubt” that it will correspond to the competent District Courts in Federal Criminal Proceedings (mixed or specialized), the knowledge of the repair of the damage.

For this reason, the judge considered denying the protection. With this sentence, the trial judge must continue with the process to try to pay.
