El Chapo Guzmán says: I will not make a deal with the U.S. or rat out anyone

Counsel for Joaquin El Chapo Guzmán confirmed to Borderland Beat,  that he will not accept a plea deal with the United States, nor will he cooperate, leading to indictment, or give information of any collaborators he has ever worked with.

If that means life in prison, than he will take it with head held high,

“Joaquín el Chapo Guzmán will not negotiate with the United States Attorney's Office, nor will he accuse any of the people with whom he has ever collaborated, on the contrary, he will face every test that the US government may have against him, even if it means the possibility of facing life in prison, said El Chapo’s lead attorney, Eduardo Balarezo.

Balarezo goes on to say that he is firm in the decision that he will not enter negotiations with U.S. prosecutors, “as many others have done”, but will have dignity to face justice without giving up anyone else.

Frozen Fees

Still in question, is the possibility that Balarezo’s attorney fees, and the fees of other attorneys privately representing Chapo’s may be frozen.

Money used for defense must be “clean” money not gained through illegal means.  Because of his alleged lifelong actions in drug trafficking and organized crime activates, in the case of El Chapo, it would appear to be a tough task to prove.  Same can be said of his family.  The glaring question is, how will the legal defense tab be paid? The government opinion is that he does not qualify for appointed counsel.  On one hand the government contends this, yet on the other they allude to possible freezing of fees.

According to the Mexican press Joaquin El Chapo Guzmán will not accept a plea deal with the United States, nor will he rat out, lead to indictment, or give information of any collaborators he has ever worked with.

Balarezo goes on to say that he is firm in the decision that he will not enter negotiations with U.S. prosecutors, “as many others have done”, but will have dignity to face justice without giving up anyone else.


It is the contention of prosecutors that El Chapo’s money is derived from drug trafficking and other illegal activities, so it does have the power to freeze the funds.

United States prosecutors have already gone on record stating they may freeze the fees of the attorney group defending El Chapo.

When asked about concerns that attorney fees may be frozen, or tied up in litigation, Balarezo answered Borderland Beat by the following statement, “Of course I am concerned. However, the government has already taken the position that he is not eligible for court appointed counsel and that he should hire private counsel. So how can they now argue that he cannot pay private counsel? I have reviewed the law and the facts and am confident that what I am doing satisfies both.”

The government filed this in a letter to the court on  August 11th ;
“Certain private counsel have contacted the government and advised that they have obtained signed retainer agreements from the defendant. These attorneys, however, have sought prospective, written assurance that the government will not seek, at any time, to forfeit any legal fees collected by them for their representation of the defendant. In response, the government has advised private counsel that it will not grant a blanket, prospective assurance that it will forgo forfeiture of any and all funds received from the defendant for his legal fees.”
Balarezo also again mentions how difficult the conditions of imprisonment is for his client, saying that he has been denied visits, even with his wife and that, "in the United States every person is innocent until proven guilty, and “Mr. Guzman” should not be an exception."

Although, there exists a provision in law that allows for “Special Confinement Conditions” to apply in high risk cases, those are rarely applied and just about never in drug trafficking cases, typically it is used in high risk terrorists cases, like the Boston Bomber.   Prosecutors contend, El Chapos two previous prison escapes were aided by individuals who visited him in Mexican prisons.

As for a sweet plea deal, that seems to have weak potential, it is doubtful that he would be offered an excessively generous deal, such as those seemingly handed out like candy to other hard hitting narco bigs.

The legal team is impressive and El Chapo will need them, as the  direct evidence case is massive; 48 videos, telephone and in person recordings, documents, scientific reports, drug ledgers and the testimony of the Flores twins leading the way for the prosecution.  Most likely the testimony of Damaso Lopez Serrano will also be included and perhaps that of his father,  Damaso Lopez Nuñez, former close associate and right hand "compadre" of El Chapo,  who is rumored ready to cooperate.  It is rumored that it was Damaso Sr. who was behind the arrangement of his son turning himself in to U.S. authorities in exchange for cooperation.  If Jr. stayed in Mexico, he was dead man walking due to the violent war  with El Chapo’s sons.


The interview


Damaso López, is the former deputy director of the Puente Grande max security prison.  Puente Grande is the first prison El Chapo escaped from.  Damaso gained status with the capo by assisting in the  escape in January 2001.

In February, 2017, Lopez Nuñez sent a representative to meet with Riodoce journalist Javier Valdez, for an interview on his behalf.  A few months later, Valdez was gunned down in the street outside his offices.  Riodoce editor Ismael Bojorquez, says the interview incensed “one side of the conflict” which resulted in Valdez’ murder.  In the interview Lopez Nuñez representative denied the accusation by the sons of El Chapo, that it was him who had El Chapo’s son Jesus Alfredo kidnapped in Puerto Vallarta. Chapo’s sons said in an open letter that Lopez Nunez tried to have them killed.  In the interview with Valdez, it was denied attacking Guzman's sons and called "El Mayo" his friend.

Dámaso's envoy, whose headquarters is located in the Eldorado area a part of the San Lorenzo Valley, in this capital city - although he also had command in La Paz, Baja California Sur, and Mazatlán - said that Licenciado is not broken with the Sinaloa Cartel and that  he retains his friendship with [el Mayo] Zambada. 
He said that Los Menores [The minors, Chapo’s sons] ”have not respected the agreements and have provoked them violently for about a year, with people and equipment, as part of a coup against Lopez Núñez, "taking advantage of my good faith, with betrayal, they have spread the rumor  that the DEA supports me, but it is not true. I have pride and I respect the codes ".


"Did Damaso split from El Mayo?”


-Of course not. Mr. Zambada is a fine person, who is always respected.

"Is Dámaso out of the Sinaloa Cartel?"

"He and the group of leaders are friends with Mr. Zambada, and logic and facts speak more than a thousand words".

"Is it a friend of Mayo and enemy of Los Chapitos ?"

-Iván, Alfredo and his uncle are sick with power, but it is through abuse that they become forced friends. They support them more out of fear than because they are right. He (Damaso) is a friend of el Mayo but also a friend of Mr. Joaquín Guzmán.


"It cannot be said that Dámaso is an enemy of Ivan or Alfredo, although he knows that they are misdirected but at any moment they can reflect and mature. They do not want Dámaso, but Dámaso has said that he cannot be enemy of the children of a person "to whom I love and I appreciate".


"Can this be solved?"

"Everything is solved by good communication. We have only defended ourselves, but we have never provoked them. They have a year provoking Licenciado.


He warned that it has been painful for innocent people to die and that the families of those involved are suffering and remain in constant "torment".


He said that el Mayo has a crucial role in the Sinaloa Cartel, which for many are suffering  with the conflict between the group of López Nunez and the brothers Guzman Salazar, backed by his uncle, Aureliano Guzman Loera, el Guano.


"Mr. Zambada is a pacifist and he has fought for this to be solved, but the boys and his uncle, Guano, do not obey him and do not respect Mr. Joaquin Guzman Loera's decision to keep the businesses as they were, each in their regions, and to have communication and coordination."


If Dámaso was treacherous, he added, "He would not have the friendship or confidence he has with Zambada."
The Letter


In a letter sent to journalist Ciro Gómez Leyva, the sons of Guzmán Loera accused Dámaso López Núñez of attempting to kill them, at an alleged meeting which they were summoned by Dámaso. Chapo’s sons indicate that they were injured and Ismael Zambada García also attended the meeting. The attack would have been on February 4 and the Guzman Salazar reports indicate that it was in the mountainous area of ​​Badiraguato municipality.


"On 4 February 2017, Mr. Dámaso López organized a meeting with  Mr. Ismael Zambada and the family of Joaquin Guzman, on the issjue of Dámaso López ordering the kidnapping of the children of El Chapo ', "the letter reads.


Once in the meeting place, they add in the letter, "they realized that Dámaso López was missing, soon shooting began against the personal escorts of the family, the escorts were killed instantly,  Chapo’s sons realized that they were betrayed by the Dámaso Lopez to be assassinated.".

"Mr. Zambada and the family of Joaquín Guzmán exited the place, only to discover armed people under the command of Dámaso López everywhere,  trying again to take their lives,   they got lost among the mountains, without having notion of where they were. They were injured when traveling several kilometers finding a small town and  being aided by people of the place.

      I would like to hear from BB followers, what specifics would the government want chapo to share? At first glance it would seem he is the 'big get' top of the food chain, so what can he offer? but if one thinks deeper, his cooperation could be the most valuable ever attained with worldwide consequence.

    11. @Chivis I actually have no clue what the government would be willing to trade for leniency when it comes to guys like Mochomo and El Chapo. Usually I have a pretty good idea. But those concessions typically only apply to guys that are lower down the totem pole.

      The only thing I could think of would be information on operations within Colombia, Peru, Venezuela, etc. where the coca suppliers are. Or information on suppliers in China and Southeast Asia in the case of chemical precursors.

      But honestly the longer guys like El Chapo rot in solitary confinement in a United States cell... the less actionable information they are going to have as it relates to suppliers and operations. They get further and further disconnected from it. Which isn't the case when they are in a Mexican jail and can still run things from behind bars. Completely different ballgame when you can't even meet your attorneys face to face and have to use video uplinks that are monitored by U.S. authorities.

      I don't think there is a deal to be made for him at all. No surprise he's going to publicly proclaim he's not a rata. To be a rata you have to be offered cheese. The U.S. Government isn't going to offer him any.

      If there was a deal to be made I only see it being related to his children. In which case if he thought he could do something to help his children he'd gobble up any cheese he was offered like a good little rata. But alas... no hay queso.

    14. chivis i think some people have already stated for the most part that he wont get a deal because honestly the DEA,FBI and CIA already know everything jajaja...i mean they know mayo and RQC are in the mountains and their sons are well ahead in monthly bribes paid off...and they probley told chapo if he had stayed in the mountains he too wouldnt be in the position he is in jajaja..but yeah whenever the kids of chapo cant pay the monthly bribes to that certain politic or general or someone is able to pay more they too will be caught...but chapo made so much money the kids should be good for a couple of years at least jaja...mayo and RQC will only be caught once they break their agreement with the DEA,FBI and CIA and come out those mountains..so yeah added to all that and chapo being in prison almost the past 2 years pretty much leaves him with nothing to offer...people may say what about his connect or his workers...well the DEA,FBI and CIA all knew who his connects were throughout his career...catching them is another thing..takes a whole other countries cooperation and help and of course cost tons of money to do those things..and all his workers work for his sons or mayo and again the DEA,FBI and CIA all know them as well..as does mexico..so yeah el chapo has nothing to offer...he will die in prison..he had a good run though..

IMO, the only deal is for his family to move to the states; it's not a good deal at the moment because his kids are still running the biz and his partners haven't turned on him, especially now that El Lic and son are locked up. The Government should be offering the deal to Damaso, the twins took one,they will get an 80% solution in doing so than trying to deal with Chapo... just my 2 cents

Maybe because he used violence less sparingly and thats why Mayo (and maybe El Azul as you say) are running the show now.
      I believe Chapos has the knowledge to totally disrupt drug supply but he's not going to b/c neither US or Mexico want that to happen, and if he talked everybody he cared about would feel the wrath! Chapo probably gets much better care and attention than what we read b/c the US needs to keep him happy until he dies in my opinion. Plus I believe Chapo is loyal to his roots and he wants the money to keep making its way to his people and area he is from.

  9. As it should be, my father was imprisoned for drug sales in the late 80s he received 15 years. They offered him less time if he "cooperated" with them. His actual words were "I'm not going to give up my people/associates because my dumbass got caught" he knew what he got himself into and it was no one else's fault.

  11. A deal with Chapo, in spite of all the evidence they have?? Come on now... He himself said he is the biggest producer of drugs shipped to the US!! That translates into millions of victims, not just the addicted, but the victims of the addicted, the families, the friends. Countless dead, not only in Mexico, but Chicago, New York, Los Angeles. Overdoses on Fentanyl is reaching epidemic proportions, heroin is back, purer and more potent than ever. Chapo has killed more people than Adolph Hitler or any other despot in the last 500 years. A deal?!?! Would the world court have offered Hitler a deal?? If he provides 80% of the drugs shipped into the US, how can it be feasible that he is given consideration for ratting out on the other 20%. Im sorry, I work in a Substance Abuse Program, and I see first hand, every day, the ravages of drugs on the abusers, their victims, their families and their friends - May they lock him up, under the worst conditions, and take away his human rights, as he has done to millions and millions of folks...

  16. Man, this stuff sure is interesting. But who knows what happens behind closed doors. To be a fly on the wall...

    Chapo cooperating could (probably would) eventually point back to US gov involvement at some point, at some level. Why would US want to take that chance. They have the info to convict, why take the chance that your prisoner will tell on you.

    But time will tell.

    Keep an eye on the menores, mayo and co., and cjng. There are no accidents at that level. Just my opinion though.

    The important question is, who will be designated as the next head of the snake.

  20. Does it matter if he snitched or not? The US probably already knew all of the deals done with the corruption in Mexico starting from the Presidents, military, Police, to the DEA/CIA/FBI! They have been part of it all along. What have they done to the real Drug dealers ( Presidents, politicians, generals caught red handed in corruption? Those are the real Kingpins!) Till this date, Drugs continue to flow, new cartels, new bosses, corruption and massive killings and what has the US done? Yes they nabbed the biggest Dealers but the drugs continue to flow world wide. They let the cartels grow, take their money and the 23 million enacted for the DEA in 2016 pays for their program. They collect 23 million from one Kingpin and where does the rest go? yes some goes to the state police department but that is chump change from all that they confiscate in a year( Cash, weapons, homes, cars, planes, jewlery, etc...). How much goes to the main problem that is the drug addiction? How do we resolve the problem of consumers? Who will be the next Cartel King Pin, and the next, and next , next etc... We need to kill it at the root! That takes every single person to do their part as in Mexico as in US and that my amigos is the million dollar question....

      Of course the problem is the people that consume it, but give me a solution. We know the problem exists because of the high demand and all the drugs continue to come in no matter how many people they bust or they snitch on each other ( which is not the way of the old days que te amarrabas un huevo and if you got caught just take the punishment). Yes I know money goes to addiction clinics, Rehab classes but there is so much money left over that they rather let Kingpins get rich so at the end they take all their money and move on to the next money maker.

      From your comment about people blaming others of course people always want to blame others but what would be a good solution. Legalize all the drugs let People itself ( as you say ) buy it, tax them just like what they are doing with Marijuana, which is very successful for the Govt and the growers? We know what you are saying but were looking for solutions... He is only saying this so his own cartel don't kill his sons. Or try to have him killed. It's a fact he will die in jail. He is never coming out.   33. We know where everyone is cartel bosses .. the military has intel units by the borders and they have satellites imagine if we knew where bin laden was always hiding we can find anyone. As a matter of fact we have military weapons training facilities about 5 miles away from the border in San Diego. So cartel bosses don't make too much noise because they will find you.

  39. This reminded me when I was in country fighting a case. There was like 6 guys from Sinaloa who all snitched each other out and they knew about it and were not trying to take a plea. They were talking about taking it to trial and thought they would get a sweet deal if they refuse the plea bargain some how but the plan backfired, The prosecuter had all the information on them for pointing fingers at each other so they got terrible plea deals. They changed their minds about going to trial but got a nasty deal, should have taken the first or second plea. Terrible

Why should he share anything at all if the U.S. government has already decided he's guilty without even going to court and they are illegally trying to prevent him from retaining an Attorney. The law states that everyone is entitled to an attorney however they don't want to give him a court appointed attorney nor allow him to get representation. This is completely criminal in itself. As far as BorderlandBeat making all these judgements in this article, non of it has been proven. You don't know that Damaso is friends with Mayo ...yea right!! If they aren't offering him a plea deal then f--- em. why would anyone offer any information in light of that

  48. @Chivis they would definitely want information on his connections for precursor materials in Asia and also his money laundering connections in the global bank system. They will dangle that irresistible carrot(a possible deal for his kids) in front of his face but he will have a very small window of opportunity before that carrot rots and is no good anymore
