El Chapo: "No tunnel will be built to his bathroom" say feds

This morning Federal prosecutors in Brooklyn New York, issued their plan in keeping the Sinaloa Cartel leader known as “El Chapo” Guzman in custody.

The feds distributed the memo (full document below) saying that measures have been made to assure there will be no prison outbreaks while Chapo is in United States custody.

Angel  Melendez, the special Homeland Security Investigation agent, said at a news conference “I can assure you no tunnel will be built to his bathroom”,   this in reference to Chapo’s tunnel escape from Mexico’s maximum security prison No. 1 known as “Altiplano”, in the state of Mexico.  Before Chapo’s escape from Altiplano, there had never been a successful escape from the prison.

Chapo’s escape tunnel was created from one mile away, and opened into his shower floor.

Melendez also spoke of seeing Chapo for the first time upon his arrival, he said he looked into Mr. Guzman eyes and saw “surprise, shock and even a bit of fear” now that he was facing “American justice.”

That is no surprise to anyone following the extradition saga of El Chapo, his surrogates speaking on his behalf, have often mentioned the fear El Chapo had of being extradited to the United States.  He was under the impression he could even receive a sentence of death.

However, that would not happen because of the extradition treaty that exists between the United States and Mexico.  Capital punishment is off the table, or there would not be an extradition.  The United States reconfirmed as much in 2016, and also removed the murder charges that were pending against Chapo.

There are indictments against Chapo in six federal districts.  The feds say they decided to prosecute Chapo in Brooklyn, with the assistance of Miami federal prosecutors, determining the two offices working in conjunction would bring the strongest case against Chapo.  However the cases in other districts will remain opened.

The U.S. is seeking a forfeiture of 14 billion USD against Chapo.

Prosecutors also announced plans to call dozens of witnesses, including agents, rival cartel members, and public officials.  These witnesses will testify to the massive scope of Chapo’s drug organization.

No doubt the star witnesses will be the Flores Twins, known as “The twins who betrayed Chapo”.  The brothers went undercover for the U.S. which included wiretapping. 

In its memo issued Friday, Mr. Capers’s office said that it would seek a criminal forfeiture of $14 billion against Mr. Guzmán and announced that it planned to call dozens of witnesses who would testify about the staggering scope of Mr. Guzmán’s criminal enterprise: its multi-ton shipments of drugs in trucks, planes, yachts, fishing vessels, container ships and submersibles as well as its numerous killings of witnesses, law enforcement agents, public officials and rival cartel members.

The least he will get is mandatory life concurrent to the others then after his convictions in the other jurisdictions they run that consecutive upon completion of his first. Sammy the Bull flipping on Gotti would be considered small potatoes compared to what this guy knowns in regards to the infrastructure (shot callers) of the Mexican underworld. Under Mr Guzman's leadership, the Mexicans rose the top of the food chain in the global criminal hierarchy. He basically ran Mexico with an iron fist for 20 years. He could probably do 10 years standing on his head and go home to his jovencita. I see this case ending up like Vicente's case where agreements are made and money is paid. It is part of a bigger and grander master plan. It will be Chapo's last escape but not before he gives a big middle finger to friends and foes alike.

    2. I don't know about the ref of the reader of borderland beat but I admire Chapo. he came from nothing and became bigger than life. He is no more "evil" or "bad" than presidents or goverments. The difference is they're deeds are done under the pretense of "national security", the champs of the world are born out of inequality and government systems that are made in such a way to hold most of its citizens in poverty while the few enjoy the hard work and sacrifice of many. It's easy to say if I were them I wouldn't sell drugs I would work 18 hours a day to not even make enough to feed my family but they live in the us where even if you're among the poorest you live In relative comfort: so all you righteous people out there don't speak when you don't know the first thing of what you speak of.     -He's entered a plea of "not guilty." What might be his legal strategy?
    -His attorneys are court-appointed. Does that mean public defender? Who are his lawyers and what is their motivation? Why doesn't he get his own lawyers?
    -The prosecution is going after $14 billion. How will they confiscate land and businesses and other money-laundered assets in Mexico? Are his compadres scrambling to protect those? How much cooperation will the Feds get from sources in Mexico for evidence, etc.?
    -What's the reaction in Mexico and Sinaloa?
    -How are they going to find "a jury of his peers" in New York City?
    How much money will the trial cost? Will any of the judges or prosecutors be threatened/set up for murder/bribed? What are the chances of him being found innocent? If that happens would he be extradited back to Mexico to face charges there?

    Would the Flores brothers and Vicente Zambada appear in court to testify?

    And, of course, what everyone wants to know - will Chapo snitch? Will he name names and provide evidence on corruption at the local, state, national, international levels? Who might he take down with him? If he does turn states evidence, will this mean a lighter sentence? I realize it's all speculation at this point but you guys at BB have a way better understanding of all this than the American mass media.

      He is a part of "Federal Defenders" a group who represents the poor. http://federaldefendersny.org/about-us/

      I am guessing it is a temporary move to protect his rights until other atty’s take his case or gain rights to practice law in NY. I truly do not know. He has always worked with the guidance of a power atty whose name I can’t recall but I think is in Tx or DC. I checked both Florida and NY to determine if he has atty’s (private) in either and he does not. Maybe a legal mind can help us out.
      The 14B is an inflated figure to protect the interests of the U.S. in any unknown assets that may be discovered. Many assets are listed in his various kingpin filings by the U.S. over the years. Of course those in Mex, Mexico has priority to seize.
      Yes the witnesses must appear in court to face Chapo.
      Snitch? Of course he will, if there is a benefit for him. They all do, except Mochomo who has not cut a deal or snitched before pleading guilty.

    4. He will not have any private attorneys at all unless they work pro bono. The federal government demands proof of legitimate assets and accounts. Nothing he has can be legitimized in the monetary sense that the US govt requires, hence we will proceed with a worthless public defender. His weak defense will be based on public defenders until he checks in at ADX Florence.

      His trial will last years though. The Feds never prosecute unless they have a very strong case. He is off the scene now. He will be isolated.

    8. For @ 5:28, yes he will get adequate but bare bones representation. BTW, the legal work is not "top notch" and they are not the best. They are bottom barrel attorneys making minimum salary compared to the lucrative salaries of top notch private attorneys. Their success rates at trial are less then 18% national average. Which means a 80% plus conviction rate for the federal prosecutors. There may be a diamond in the rough who attempts to try and make a name for him/herself but in Chapo's predicament he has NO possible way to get less then the minimum mandatory life sentence.

    9. @6:13 - Vicente's attorneys are not top notch. They are ambulance chasers like Bruce Cutler. Santangelo and Panzer take any infamous case in the hopes of recognition. Almost all their clients are doing life or maximum prison sentences and others have take plea deals for substantial prison time. Then they send enormous legal fees to the feds in the hopes they get the full amount they ask for but mostly it is average per hour low end federal attorney fees. They too are public defenders in hope of a big payoff, book or movie deal. Chapo will get sub par but adequate legal representation even though by law he is not entitled to it since he is not a citizen of the US. But fair is fair. Eduardo Balarezo, Leyva's atty is the same but good, he chases high end foreigners for clients and is known as a plea specialist. Between all 3, almost all their clients are doing extremely long and lengthy prison sentences. Because of him his client may get a favorable sentence. he did not encourage a plea, but in most cases the feds want the plea. eduardo is a good guy and a brilliant atty. I don't think he was appointed I think he had him before the extradition. let me find out.

    14. Chivis, Eduardo Balarezo is a court-appointed attorney in the majority of his cases. He is not that good he makes plea deals for a living. Balarezo was court appointed to represent Leyva. Leyva also took the plea deal rather then face mandatory life and this will come out in Guzman's trial. Balarezo thinks he is a genius on cartels but his clients would think otherwise. He has lost almost every single jury trial he has been appointed on and lost the majority of appeals he has filed. I believe a simple Bing or Google search would inform as to such. His web site is very low class and all the displayed cases are convictions, including plea deals. The wins are one or two and only for federal violations to speedy trials.

    15. The government probably won't use Vicente as a witness. He is too unreliable and a known liar. However, the do have 100's of hours of intercepted phone conversations between Vicente and Chapo discussing murders and body disposals among other things that will be brought out in trial.
