Singer Larry Hernandez extradited to S.C. 6 days ago but is yet to arrive

Larry Hernandez, singer of narco corridos was extradited to South Carolina.  

Last Wednesday, October 14 at 16:00 hrs (4:00) Hernandez was released  for the extradition, to Newberry County S.C.

Hernandez, 38, was arrested on September 28 at the Ontario International airport in Southern California, as he waited to board a plane for a flight to Colorado for an appearance in Aurora.

The singer had been held at West Valley Detention Center in Rancho Cucamonga California, which is in the county of San Bernardino.

Notable on search results for county of San Bernardino is that he was released to “SELF”.  I am uncertain if that is typically what is designated on a extradition, but it would seem more appropriate that the release in cases of extradition, would indicate whichever authority is responsible for the transfer.  Perhaps someone with knowledge on the subject,  can weigh in.

He was extradited to South Carolina to face kidnapping and assault charges.

A phone call to Newberry County Jail by Borderland Beat reveals that although Hernandez was released 6 days ago, he has not arrived in Newberry as of 8:30 AM South Carolina time today.

The Information desk officer was surprised when BB gave him information obtained on the San Bernardino County inmate website that Hernandez was extradited almost a week ago.  When asked he confirmed that Hernandez would go to the County Facility (sheriff’s) as that is the sole detention center in Newberry County.  BB was hoping to have his Newberry mug shot accompany this post but since he has yet arrived or gone through the booking process, there are none.

The officer guessed who we were inquiring about before we asked, he noted that they have received over 100 inquires in the past few days.  The Newberry County website is under construction necessitating phone calls for information.

When asked what would cause a delay of 6 days to travel to Newberry after release from California, the officer seemed perplexed about the delay, when BB suggested perhaps he was in a facility outside the county for a cause such as protective custody, he suggested Hernandez may have been a part of an interstate transfer,  that may cause a delay after a stop in another state, while waiting for other inmates being transferred to South Carolina.  He stated that sometimes they can be held in Arkansas or another southern state for a day or so.

 Whatever the reason, we will continue to check on this story.

Hernandez’ alleged victim is accused of fraud

In a strange twist, in an already strange saga, five Newberry businesses
Reyes
men paid a visit to the Sheriff office of the South Carolina city. They came bearing what they claim is proof of fraud by the Larry Hernandez’ kidnapping victim, Jose Andrade, in the case against the singe.

Restaurant owner Onesimo Reyes accuses Andrade of trickery of property ownership, in exchange for a loan. “We found out several of us had the same ownership (deed) title with different money amounts, I’m talking about 20,000 dollars.”  He says the 5 grouped together and decided to sue Andrade.

The men provide services at the venue from which Larry Hernandez and others allegedly kidnapped Andrade.

    1. if you could call county jail that would help, not the detention center. the officers there are pretty nice but we know a lot more than they do...poor guys. lor in the AM i don't know if it is a big story there if so then the newspapers or regional media should report his arrival.

      I imagine he should roll in no more than a day or two other wise why release him from socal .

      I would like to know why it says released to 'self' what does that mean, luco asked me and i don;t know either. it seems it should be Released to So Carolina custody or something.

    2. Chivis! The UCEA2 has been adopted by 48 of the 50 states, the only exceptions being South Carolina and Missouri.

      The Act sets forth the process by which a state may request surrender of a wanted individual and the manner in which that individual is surrendered.

      While there are some variances among the Act as adopted by the states, the principal requirements for extradition are as follows:

    3. There is the arrest warrant, the extradition hearing was 2 wks ago, the judge ordered the extradition based on that hearing. Hernandez waived his right to a trial in california and he was ordered extradited to face kidnapping and assault charges in SC

      Newberry police were surprised to hear hernandez left so cal 6 days ago. actually they at first doubted it was true, I referred them to the SB website.

      I am not sure what you are saying, but if I am reading it correctly you are referring to the process that has concluded.

      Thank you for the information about the hearing etc. I sure would like to know about delays in transfer. e.g. under what authority and circumstance does it happen. and the "self" thing. I think you figured it out I called the Newberry county and sheriff. also called west valley in cucomonga

    4. Hi, Chivis! Y'a don't suppose Larry got sent to Mayberry by mistake!

      The legalese is from a website w/ info on rendition/extradition. I am no lawyer! The confusion the Newberry cops have about his where abouts and the following made me wonder if Hernandez might be "free."

  10. WITSEC. Not sure why this comes up a lot with people when they don't have an update in BOP's database, etc. This isn't the same situation as he's not yet a federal inmate, but still... that's what happens when you are in protective custody for whatever reason. People aren't supposed to know where they are and the status.

    1. it is a county jail a so carolina state case. not federal.he would not be in the BOP data base and the data base he is supposed to be in (Newberry county) is down for construction

    2. Correct. Which is why my comment said I dunno why the same thing comes up in other cases (ex. Chino Antrax) where lack of info on the inmate or case typically means WITSEC or something similar. Protection for people that make a deal happens at all levels, not just at the federal level. So that could be the case here. But I mentioned in a comment before this, I don't know enough about the individual to know his value as a witness or for intelligence.

    3. This is too nuts. Where is he? You don't just "lose" a prisoner in transport. Even, if, it is a case of dropping guys off at different facilities in various states, there would be records of where the stop overs took place; where the prisoners were processed to be put up for the night--Something! SC may have goofed. Larry might be a freeman??

  11. Some small fish get transfer via private company. The drivers for the transportation company only can drive x amount of hours before resting. in the mean time the prisoners get book at local jails. Most of the time the prisoners get to eat fast food. Enjoy your happy meal because is your last taste of freedom for a while Larry.

  12. You know damn well the DEA is making a deal with Larry to snitch on everyone he knows in Sinaloa. Phone taps are in full force. What a coincidence the same time he gets arrested we start to hear about chapo being close to caught.

Then they would be handling some interrogations of el arry, just to help get him warmed up, on the US some collaboration is expected and demanded or exacted by Federales from the states, unless they want to be investigated for some of their "Mena" styled goings on...the US treasury likes to help too by looking the other way, for a cushy job later...

  15. I bet afew people will say hes in a dea or fbi lockup snitching. The reality is, transfers take forever. Youre at the mercy of the officers. And sometimes they sub contract the transfer to security companies. To go from coast to coast could take 10 days. People ive been locked up with came from new york to florida and it took 9 days. It goes like this... you leave the prison and get on the interstate, you have known pickups that may or may not be on the way. Then you have transfers that come up while on the road, that means you could go 2 states towards your destination, get a call, and have to double back thru those two states pick up an inmate, and then start again. And this will happen multiple times over the course of the trip.. i had friends leave for the east coast from a central florida jail, which is a 2 hour drive, but it took 30 hours to get there. The officers decide when theyre done driving for the day, which means they go to the nearest jail or prison and drop the transfers off while they go to a nearby hotel. The officers also decide who to pick up and drop off first according to thier route. There is absolutely no rush in these transfers.. your worst nightmare as an inmate is to hear you have a extradition hold on you.. you know youll be on the road, in a very uncomfortable, very hot or cold vehicle, for a very long time.. i had no idea it went like that until i did time..

  20. Chivis though he was in a county jail, the crime itself is a felony. A self-transport for extradition does not exist. Definitely not for this. A misdemeanor is not something they usually request extradition for unless it is a series of them adding up to a felony. Also, the transaction of one state transferring or detaining for another state is done for felonies, therefore, falling under federal. In extraditions, all scenarios, usually the state that makes the request sends detectives to retrieve the defendant or that state will deliver them, based on their agreement. There is a holding period on the defendant for that purpose and that is agreed by the two states. They are usually picked up within a few days. For him to be released and expected to appear on his own is truly unheard of in all my years of law practice. There has to be some other information not in the story. As far as. county jail, being the offense occurred in S.C., he would be detained in a county jail, nothing higher. I would love to know what really occurred in this situation. 4:34 explanation is the Wiki explanation for extradition. Under no circumstances does any defendant self-transport. The crimes required for extradition are serious crimes. To explain to 4:34 All 50 states are included in the extradition process. No states are excluded. No state is a safe haven. The only things that will prevent immediate extradition are if the defendant has serious crimes in the state holding them to answer to and if they are already serving a lengthy sentence for a serious crime. Once that sentenced is served out, the defendant will then be transported.

    1. Thank you very much! But I was speaking of Newberry County jail, the commander there told me he will be at that jail. I asked if it was possible maybe they changed that, he said most definitely not.

      There is something missing, aside from Hernandez :)

      what is your explanation for the release stating SELF, under what circumstance is that stated?

      thank you again for the great info. If I have time I will check with my friend in Newberry. Friends because I promised I am not so obsessed as to call him more than once a day. He laughed.

      I told him it would not stop after Hernandez rolls into Newberry because I needed a mugshot also, ( I kept thinking of Mayberry and Barney Fife).

    2. Thanks, Chivis. I am not certain on the self-transport. One thing that may have been considered is whether or not there was a previous criminal history. In which case, a judge would solely make a decision. A bad one as I've seen the new article about his being in Las Vegas. You have fun and thanks for all the updates you are sharing!

    ME: "good morning, I am checking on an inmate being extradited ...."
    She cuts me off " He isn't here yet..."

    I apologized for bothering her, she said it was ok, but at 8:30 she sounded very tired of these phone calls
