Menchito on Mencho: "He is not my father"

chivis martinez Borderland Beat from infobae

Rubén Oseguera González "El Menchito", son of Nemesio Oseguera Cervantes "El Mencho", head of the Jalisco Cartel New Generation (CJNG) offered the Mexican authorities supposed evidence to prove that he has no blood relationship with the drug trafficker hoping to avoid his extradition to U.S.

Oseguera Cervantes, number 2 of the CJNG, is being held in a maximum security prison in Mexico. A few years ago he was transferred from the Puente Grande, Jalisco prison to CEFERESO de Chiapas and later to the maximum security zone of CEFERESO in Hermosillo, Sonora, fearing an escape.

A collegiate court rejected his request for amparo against extradition, so it is expected that at any time he can be taken to the United States.

The sentence issued by Adriana Alejandra Ramos León, Eighth District Judge in the State of Oaxaca and confirmed by the Second Collegiate Court in Criminal and Labor Matters, states that "El Menchito" said that he is not the person who appears in the photographs presented by the United States embassy in Mexico when requesting his extradition.

He also presented a birth certificate proving that he was born on February 14, 1990 in the US city of San Francisco, California, that states he is the son of Mexican parents.

"The complainant refers that according to his birth certificate, which was admitted and offered in the procedure, he warns that he is not the son of (Nemesio Oseguera) as he indicated in his statement (an American agent and witnesses).

"Such a statement is not an obstacle to establish that it is not the person claimed by the requesting State ... Especially if one takes into account the existence of various elements of conviction that confirm that it is the same person, such as photographs that exist in the extradition file regarding the complainant, as well as the physiognomic identification opinion issued by the Prosecutor of the Attorney General’s  Office. Thus, when the grounds for dissent put forward by the complainant are unfounded, it is appropriate to deny the amparo, "adds the ruling.

Federal authorities presented an opinion of May 15, 2018 in which it is concluded that after different tests it was determined that the person who appears in the photographs and the inmate is the same.

On August 29, and "El Menchito" was acquitted of the crime of organized crime . However, he remains in prison facing other charges, such as money laundering.

In 2015, the Federal Court of the District of Columbia, in Washington, ordered the apprehension of "El Menchito" , accusing him of possession and use of firearms, as well as conspiracy to distribute cocaine and methamphetamine.

See below the unsealed indictment for Menchito.  It is basic boiler plate material probably created and filed to request extradition.

  2. Chivis, on the 2nd count. Is the weapons charge for carrying in the US or Mexico? How can the US have a charge on him for having a weapon in Mexico if that had nothing to do with US?

  6. hi chivis this is interesting from my point of view the us does not have alot big charges and hard evidence against him, i feel he will get a couple of years but i have also the feeling that can happen with menchito similar to alfredo beltran leyva the us did not have alot to sentence him for a big sentence but since they wanted his brother arturo so bad and did not get him they took it out against alfredo so the us to send a message to mencho or since they know to get mencho will be almost impossible to bring to the us they will take on his son

    1. funny you should bring up alfredo---that is who I thought of when reading the indictment. That is what happened to alfredo, nothing before then when deciding to indict a standardized document appears. You are very wise, that is exactly how I read the alfredo case. arturo they wanted so badly but can't try the dead and alfredo was getting ready to be free after serving his sentence. he was never mentioned before not in any BLO or CDS indictment or by any witness such as the fores twins.

If they can't get the real target then someone close will do---or so it seems. Paz

    2. Do you guys understand how little evidence the Feds need to convict someone on drug conspiracy charges and lock them up for life?

Trust me...They have 50x the evidence they need to secure a 30 year sentence. The drug conspiracy laws stateside are ridiculous.

    4. The Statute of limitations starts the day they file the indictment or is it the day the crime is committed.

    5. The conspiracy charge is no joke, I seen people get a lot of time for conspiracy.. crazy charge I might add, conspiracy to move drugs.. it's pretty much saying that they have little evidence but enough to assume their role in the drug game

  7. I don't understand how our Government in the US can charge of foreign citizen with possession and use of firearms on another country's soil. It seems rather preposterous to me.

    1. I agree, that should only apply in Mexico since it happened in Mexico but U.S makes it's own rules as it goes along lol

    2. The crime was against the US and the crime can be committed in any country. While he committed the crime a weapon was used. That alone gets you 10 years at Club Fed. Mental note, do not commit any crime against the US and use a weapon...Another inmate with nothing coming status...

    5. Not only is ridiculous but how much does it cost usa taxpayers for some zealot goverment adhole to overreach and want to prosecute ppl that are not comiting crimes withing our country. I live in the usq love the usa but i dont think we shld be doing this. Its mexicos responsibility and to make sure that mexico takes their responsabilites serious we shld encourage it with some sanctions.

    6. Mexico should start extradition proceedings against more than a few international men of respect that have employed all kind of Mexican criminals and cartel members since the 40's and did so many murders and drug trafficking, like the murders of about 30 Policia Federal agents in Sanchez Taboada Veracruz in the 80s at the hands of their drug trafficking contras then training and trafficking cocaine and mariguana and millions of dollars and weapons in rafail Caro Quintero rancho nearby for Felix Ismael Rodriguez Mendigutia, the well connected Cuban refugee (friend and partner of Juan Ramon Matta Ballesteros, and the cartel de Guadalajara, and Oliver North) who has got away with murder all his Life.

How many other cartels are they fighting? How many leaders have turned on them, been caught or killed? I think I you are in denial.

    2. I know exactly what you mean. Judges are just moth-eaten taxidermies nodding off over piles of paper they'll probably mistake for their lunch and eat because heaven forbid they would take the time to read anything. Lawyers are the very worst. They aren't like the passionate advocates who fight for people in movies. They care about judges and other lawyers. Clients are just props for their law games.

  13. Why act with so much arrogance as if you think you are untouchable? Was not this guy just stating not that long ago that he could not see his Father in the mountains that much because it was too hot? Now all of a sudden he went from claiming that was his father to totally dismissing that?

  20. CJNG are not "authorized" to "work" in the States like CDS? If yes, why they arrest the son of the big boss?

    ReplyDelete
    Replies
    1. Authorized? The jaliscos got rich and powerful by avoiding sending drugs to usa then decided to to take a stake of the usa market. They authorized themselves and now only the cds can rival the amounts of work they send and sell in usa.
