El Chapo Update on motion for a new trial

Chivis Martinez Borderland Beat

On March 26, attorneys on behalf of Joaquin “El Chapo” Guzmán, filed a motion for a new trial, refer to filing at bottom of this post.

The filing was subsequent to a juror in the trial, reached out to Keegan Hamilton of VICE , sharing with Hamilton some apparent improprieties by the jury.  The stand out being; that a number of jurors, including the juror who contacted Hamilton, were following the trial in the press.  This despite Judge Cogan’s frequent instruction against doing so.

After the filing of the motion for  a new trial, judge Cogan set today as the date the government must file its opposition to the motion.

As of 2PM the opposition has not yet been posted on the government website for documents.

Subsequent to the government opposition filing, the defense will  file a reply and Cogan will then rule on the motion and what follows.

  1. I don't want another trail, Chivis will have to travel to New York again and again, to cover the trail.

    1. 11:51 GOOD FOR-EL
Maan, that name sounds like Superman's daddy.
In Mexico el chapo would not have the opportunity, my guess is his lawyers paid for the cable, dirty devil matherfackers, need to get disbarred, but their daughters may get to be billionaires and famous like the daughters of OJ buddy Robert George Kardashian. Get Picshurs early.

    4. 3:09 feeling guilty just cements it,
      Mophaka knows he is guilty.

  3. Personally I hold that juror guilty of misconduct and subject to misconduct punishment. A thousand dollar fine would persuade the individual to not deviate from the judge's crystal clear instructions to the jury.

      they all participated,
      maybe one sang.

Everytime I check the time on my camo PHillip Patek watch that El Señor gave me, I remember all the good advice he gave me while I was providing security in the Golden Triangle.

  7. Those jurors are a bunch of trash. Even any who didn't disobey the judge's orders are trash for not immediately reporting any knowledge of other jurors misbehaving. What did those people think the judge meant? I think Guzman will get a new trial, and after a long time and incredible additional expense, he will be found guilt and sentenced to life. The jurors who misbehaved and broke laws should be prosecuted and punished.

    1. Totally agree. With a hefty fine!

    2. The jurors could ask for more evidence,
like that suppressed by the government.
Or let the defense call on certain protected witnesses el chapo and Co used to work For, like Arizona Brass Balls band, I remember Sammy "The Bull" Grabanos went to work there after he sang to sink John Gotti unt he got arrested por chaquetero, there they also got Joe "Bananas" Bonanno's memories, but ol Joe never went to prison, because he delivered the whole shebang to the new and actual owners of mobster business in Arizona, hey! Joe Arpaio the apache Sheriff there all that time used to be a DEA agent back then before he got ahold of the plaza, and he got a pardon from the NY mafia that included Rudi Giuliani who is now a Russian puppet.
As The World Turns should have as many twists.

  8. Guess we can expect a new trial from this erroneous action by jurors. Facing a life sentence, options are but 1 for Chapo to minimize this outcome. His access to an invisible bank account from US government will definitely be fought in the courts for years to come. An expense the US taxpayers will not be happy with.

One of the many benefits of drug lords I guess.

    1. Hey, if 30 million dollars can be used to conclude a big shit cake is Nothing but a Nothing Burger, even if later determined that there is something there after all, some millions can be spent on El Chapo rather to get him released.

  10. Any real lawyers out there that can comment on whether there is a chance this might go in chapo's favor? There seems to me strong evidence that these jurors didn't act appropriately. But I have no clue how much weight that actually carries when asking for a new trial

Next thing you know they will be trying to legalize borregas, no???

    3. I'm surprised they agree. Texas lawmakers are known for their tough stance on any drug. Like jaywalking.

    4. 3:38 - Yes there will still be some black market, but most people would still rather go to a dispensary. I mean there are people out there making moonshine, but I wouldn’t say that business is flourishing, would you? Just like with booze, most people would rather consume something that’s been tested and regulated. Regardless if it costs more.

I love the word “grifa”. Shits way to funny.

    1. All the rules were broken...you cannot say ok were done here just because of the notoriety of the defendant. The rule of law must always prevail. There was gross negligence on part of the jury. This requires a new trial unfortunately. If this was anyone but Chapo they would walk.

Despite his acknowledgment of drug trafficking for decades. Along with his ego to inform the world of his power and control of the drug world. He will be granted a new trial.
Expect the courtroom circus drama to continue 2.0 version.

    6. 1:05 before you can make a Capital Case, you have to return El Chapo to first base, according to unilateral international treaties that do not contemplate sending American criminals to Mexico under any circus-tance, even if they are Mexicans like
FECAL and Zedillo, they are protected.

and Federales can't make states charges federal,
El chapo can make federal shit mound with the proper spin and twists, maybe even parfium it to suit every taste if Bladdermir Putin doesn't get involved soon...

  16. Is it even possible for Chapo to get a fair trial? Unless you've been living under a rock for 20 years you've heard all the stories about him. Should we lower our standards and ethics simply because of who he is? Does he even deserve a fair trial? I'm really asking.
