El Chapo Trial: Chapo ran "Cocaine Trains" to NYC, says Tirso Martinez

Chivis Martinez Borderland Beat
Prosecutors want "Fast and Furious" off limits

About the cooperative witness:

Tirso Martinez-Sanchez a Mexican native, was arrested in Mexico on Feb. 2, 2014, and extradited
from Mexico to the United States on Thursday, Dec. 17, 2015.  He was facing decade-old charges that he shipped tons of cocaine into this country.

Martinez employed a network that included railroad cars to ship and store cocaine between 1999 and 2003, according to the 2004 indictment. [see hearing transcript below]

Martinez worked with the Carrillo Fuentes and Beltrán Leyva organizations, as well as Colombian traffickers  Victor and Miguel Mejía-Múnera.

Martinez had been held in the Altiplano No.1 prison in Mexico before being brought to New York.

On the State  Departments  website it states the Martinez-Sanchez organization used front companies to traffic cocaine in boats, rail tankers and trucks across Mexico’s border with California and Texas and on to major U.S. cities, including New York, Los Angeles and Chicago.

The witness was the leader of the MSO and was as an importer, transporter, and distributor for other large narcotics traffickers, such as the Juarez cartel, members of the Federation. Martinez is responsible for organizing the laundering and remittance of millions of dollars drug proceeds back to Mexico.

It is believed that between 2000 and 2003, the MSO’s railroad network imported, transported, and distributed approximately 76 metric tons of cocaine into the United States.

Today's testimony

Martinez, once a most wanted felon, acted as a distributor facilitating drugs into the United States, is now on the witness stand in the trial of El Chapo as a cooperative witness.

The witness said that the drug operations of the Juarez and Sinaloa cartels were consolidated after the death of Amado Carillo Funentes.  Martinez, who has a laundry list of monikers, including “Futbolista” [footballer/soccer] because of his love and obsession with the sport compelled him to purchase futbol teams.

He testified to working for both cartels between the 1990s and the 2000s

The two cartels worked in tandem with an alliance , he explained, in the early 1990s, with Carillo as leader of Juarez Cartel and Chapo and El Mayo Zambada as leaders of the Sinaloa Cartel.

After Amado’s death [at left] by a botched plastic surgery, one of the second tier leaders  Eduardo Gonzales Quirarte aka “Flaco Quirarte”, had a mental break down and even shot himself which left him so impaired he was forced to “retire” from the business.

Tirso spoke describes the suicide attempt like this: "He was very high and a patrol attempted to stop him. He fled instead. He called Alvarez Tostado and told him, 'Compa, I'm not going to let them catch me. I'm going to kill myself instead."

He shot himself in the head.

It was this event that turned the reigns of Juarez to Amado’s brother Vicente and the cartels merger.

The merger created a stronger business model for the two cartels.  It meant more influence in corrupting officials and police. It also meant the sharing of plazas [routes/cities] and ports.

Cocaine train

Martinez testified about how the cartel used trains to ship drugs to Chicago. Each cocaine shipment with 1,200 to 1,800 kilos. These were worth up to $30 million in Chicago, earning Martinez about $200,000 to $300,000 each shipment.

Martinez says he met Chapo for the first time in person in 2001. This was just after his escape from a Jalisco prison.  Martinez says he and his boss were taken to a cabin outside Mexico City, towards Toluca.  Hoods were placed over their heads so they could not see where they were going.

Martinez testified that Chapo boasted about being the conception  person of the cocaine train they were using.

Alfredo Vasquez, Martinez’ boss lied to El Chapo about how many railcars they had, saying they had up to 60 when it was far less at about 6 to 8.

He says he transported cocaine via rail tanker  used for cooking oil.  This was between 2000 and 2003.  It was sent to Chicago, NY and L.A.

He said, Chapo put them on notice to expect larger shipment coming through the rail system. 18-20 shipments between 30 to 50 tons, were sent worth $500-800 million.

After the cocaine arrived in New York and Chicago, it would be unloaded from the tankers  at warehouses into cars with hidden compartments. They would coordinate drop off of the cars, at McDonalds and Burger King.

They would go inside to meet the pick up contacts and give them the keys.

What happened to Flaco after shooting himself in the head?

Eduardo González Quirarte

After vanishing for a decade and a half, Eduardo González Quirarte, reappeared in 2016, albeit through his attorneys.   He “emerged” to initiate an “amparo trial” to rid himself of those old nagging arrest warrants.

In August of 2016 through his lawyers, he presented two demands for guarantees before a District Court of Amparo in Criminal Matters in Mexico City.

It turned out to be a smart move, because in March of 2017, the judge granted him protection in the federal judicial system and annulled the warrant that would have put him behind bars.

If he is called to answer for crimes connected to the actions of the criminal group of the Carrillo Fuentes in Quintana Roo, from the 90s, he is set with a court ordered amparo that should protect him against charges for crimes attributed to him in Chihuahua.

The amparo renders ineffective “the arrest warrant issued against the complainant, as probable responsible in the commission of crimes of organized crime; against health in its modality of introduction, transportation and extraction of narcotics and collaboration to promote these modalities; and collection of firearms and ammunition for the exclusive use of the Army, Navy and Air Force.” [from the ruling]

The accusations arose from the arrest of some assassins of the Carrillo Fuentes clan between 1997 and 1998, and from the search of a building located near a deposit of Petróleos Mexicanos (PEMEX) on the road from Ciudad Juárez to Casas Grandes. On the property, which Eduardo was seen entering and leaving, firearms and boxes of cartridges caliber 7.62 were secured, and a laboratory for the production and transformation of cocaine was discovered.

The accusations against the plaintiff for organized crime were due to his alleged participation in tasks such as the provision of money and administration of various assets of the Juarez Cartel. He was no longer a part of the cartel after the merging with Sinaloa Cartel.

The  United States named González Quirarte on its list of drug kingpins on May 31, 2002, the same date that the capo Ismael "El Mayo" Zambada was sanctioned by the Treasury Department.

According to data from the Federal Office for the Control of Foreign Assets, he is charged by a federal grand jury in the Western District of Texas since April 21, 1994, for allegedly participation in the crimes of conspiracy to possess with intent to distribute large amounts of cocaine and marijuana, possession with intent to distribute cocaine and conspiracy to participate in money laundering.

    1. at times today the judge had to once again wake up jurors. I have to liven things up in the posts like today by adding lots of backstory stuff. it is difficult but we have some excitement coming down the line.

    2. Chivis any idea when the trial will end? I plan to celebrate when this punk gets life for all hes done.

    3. apx 3 more months i predict the start chopping off witnesses off the list. this is another guy that makes little sense in using.

      Delete
    4. Chivis is right, the witnesses that we will really find interesting are 3-5 days out. All though the trial is scheduled for 4 months, I have seen speculation that it will last upwards of 5.

Considering we are 20%-25% or so through, there has been some interesting characters.

Without being able to see the actual trial, it appears there is a lot of pauses for house keeping. As a juror, this has to be draining. Also, defense attorneys seem to always have more “courtroom charisma” as they tend to fight for the audience affection, while prosecutors come off as monotone in manner.

      Mica

      Great backstory addition Chivis!

    5. God damn 5 months??? I wonder how much this trial is going to cost.. and quick question if anyone can answer- if i had got picked for any trial like this, i would do it 100%- but how does that work with people being out of work for 4 or 5 months??? Im not missing work if nobody paying me- amd not no 14$/day for food or whatever they give you for regular jury duty

    6. hands down best el chapo trial coverage anywhere. the short tweets are fine but unless you are a student of narco business you will be bored and lost. which is why the jury falls asleep. your coverage gives meat on the bone, and backs it up with documents not found elsewhere.

I am not knocking other efforts just stating the obvious.

mica with the jury falling asleep they will go to plan B. and shorten the trial.

      chivis how many witnesses?

      Delete
    7. It was 14 until the week or so of trial and they added 4 more one being Martinez the pilot. So 18 witnesses

      Delete
    8. It’s minimum wage pay and unless it’s a high profile like chapo then you get per diem for meals a day and a hotel stay .

      Delete
    9. In federal cases the compensation is the same across the nation. 50 a day, after 10 days it goes to 60. the hotel is mid range price, but in NYC everything is pricey. meals are provided at the hotel and court. this is for all 18 jurors. 12 regular and the alternates

and in this case it is for partial week. the judge approves 3 days at a time. the marshal handles the food, transportation and lodging.

      Delete
    10. Thanks for the reply- so what is the incentive for anybody to serve jury duty??(excluding this trial) Why would anyone choose to do this and lose thousands/tens of thousands of dollars from missed work??? Sorry if this is a stupid question- it just doesnt make sense to me

Well if it is a hardship then you could get off. I was selected for a famous case and about fainted when they said 5 mos. I was able to get off because I am CEO of our foundation. 2 mos i would do. as it turned out, he pleaded guilty mid trial and it only lasted 6 or 7 weeks. creepy looking killer. he turned around in his seat as I was talking and stared at me in a way that was bone chilling. even with the smile.

i say everyone should serve at least once. chances are slim of being picked. I have been picked three times and served as foreperson. it is an awesome experience that books can't teach. many employers give jury pay I am not sure if it is a tax break for them. you cannot get fired for serving.

  5. There we go .. where is the Sinaloa hater that claims Chihuahua is as invaded by sinaloenses.. this is evidence that Sinaloa had been operating in the state for decades alongside the Juárez Cartel .. there was no invasion simply in 2008 the cartels split up and people had to pick sides .. they did so based on who they were the closest to, who offered the better deal and who they thought would win the war ... no one cared or cares to this day about “state pride” like that little baboso

Even though they've been instructed not to, it's just human nature to be curious...at least, intelligent humans anyway. And if they have to be woken up every day, then maybe they're not fully comprehending the legal points of this case.

Maybe Mayo - but not in person, by encrypted video feed bouncing off the Sinaloa Cartel satellites. With commentary by Sean Penn.

If you think the prosecution is running a circus here, just wait for the defense show! There are rumors that Sicario 006 will be appearing as a cooperative witness for the defense. She will be demonstrating weapons technology and showing the jury how she's been trained to kill with bare hands, feet, and teeth on Chapo's orders. Stocking up on popcorn...

Don't assume Sicario 006 is a male. She just uses the masculine form cause she's in clever disguise while online. Remember, you read it here FIRST

  15. Is it really 5 million for the defense cost between all 3 law firms? Leichtman,Purpura and Ecuador's own Balarezo. How does the government allow these payments to be processed? From which legal entity in USA or Mexico? I mean they don't even let his sister or family see him imagine the scrutiny for retainment fees? Mayo's daughter day care center or the empresa Lechera? I know they had to prove it for its legal revenue. So how? straw lenders? What? Politicos? Who. Paying for that.

    6. Well the article has errors. Mochomo did not blame chapo, his bro arturo did. In fact mochomo's former cellie and good friend told me 'Fredo" did not blame chapo.

      that is for starters...
also the family can't pay for his defense because it is dirty money. they would if they could but got a stern warning from the gov they will scrutinize each penny. there are court filings I have posted about this. the payments made so far are from friends out of the business. and the atty team is hoping the gov will pick up the tab as they have in every other case.

      but they are concerned...paz

      Delete
    7. Government picking up the Tab? What? You mean to tell me in other federal cases the government picked up the tab as part of a plea deal or even in the grand jury for retained lawyers? Why don't they pay the jurors more?

And yea, what about what they did to Savino BL...Nacho Coronal did that and wouldn't that cause a rift between Chapo and Arturo? That was Alfredos oldest nephew. Alfredo is 'Fredo'? If anything Mochomo is Michael and Arturo is Sonny. And Carlos is Fredo, Hector is Hector he kept the business going RIP.

I wonder who Individual 1 is or company that is legally allowed to pay for Chapos defense.

Gotta be an American. Can't be Mexican. And gotta have deep pockets because for Govt to cover expenses after that means they exhausted the option of obtaining the funds from Individual 1,

Chivis if they pay 10Ms for defense wouldn't the IRS require that Individual 1 pay all his/her taxes before hand? If they cleared 25M last tax year then they can afford the 10M expense No outstanding tax libilites I mean I can imagine the scrutiny. Gotta be a blue chip company paying because who else would face stiff resistance from the American financial authorities, who would take that chance?...gotta be a Seychelles trust fund that owns a blue chip corp in USA. All legal moves. No illegal transactions. Cleared of SARs...either way this is a trial to watch like the OJ trial.

Either way the Lawyers are doing a great job at making moves. I mean look at the social media strategy Balarezo doing. Homie countering all the shots his client taking from the Govt
Its official Balarezo is the new top private criminal lawyer in the USA. Mochomo and Chapo. Huge clout. Pro bono for Chapo!!!

Also Mochomo and Chapo share family relations w Alfredillo (Tito) Beltran Guzman. In the end its all blood family. Okay so let's be real who told on Alfredo location? Someone did sister. Only he knows. Why he didn't tell the Cellie? AND WHY THE WAR AFTERWARDS Arturo's death carried on to Hector and Chapito Isidro. I didn't see a mending of organizations. I saw Guerra.
