Alfredo Beltran Leyva
will have his sentencing hearing today in a Washington DC Courtroom. It is set for 2:30PM.
The U.S. is asking for a life sentence. The court found that sentencing enhancements
asked for by the U.S. are applicable. The government also asks that his guilty plea
result in no sentencing credit for his accepting responsibility. This is
based because of his filing to withdraw the plea.
The filing to rescind was denied by the court. This means that although he is not permitted
to withdraw his plea, so in effect he is pleading guilty, the U.S. wants no credit be awarded when calculating sentence.
In the sentencing
process, various credits favorable to the defendant, and enhancements which
give weight to a greater sentence, are calculated by using a number
scale. Refer to the image below to view

determined a life sentence was in order with a tally of 50.
One of the enhancements
is the contention of cartel leadership.
When he pleaded guilty, he was questioned by the judge regarding
leadership role. He was clear that he
was a member of BLO, and worked for his brother Arturo, but he was not the
leader.

In his recent evidentiary
hearing testimony was presented as evidence. However it was two agents who simply recited
information given to them by 3 cooperators. The agents testified they were simply
repeating what the cooperators said, and
presented no evidence to validate the information.
The cooperators themselves
did not testify, nor sworn statements offered from the cooperators.
Alfredo has asked the court for a sentence of 25
years. He was 36 years old at the time
of his 2008 Mexico arrest. He has been incarcerated
continually since that date.
An appellate attorney has been brought into the case in preparation of the
appeals process.

DeleteThis court stuff is dumb! Although he was a known trafficker, they don't know how many kilos he had crossed to the US. Over 450 kilos was just used to get to the 38 points but I doubt they have any real hard evidence of the amount.

ReplyDeleteI spoke to alfredo last night and the main reason he got the time is because he refused to turn on chapo regardless of the so called feud. Most people on here will say I'm lying but chivis will know who I am he's confirmed my relationship with him. Theirs a lot of information that alfredo had that the US wants. But this is definitely one way to pay for the "bullshit border wall" trump wants. Alfredo was expecting to get life but wanted 25 he's in great spirits his wife called me 30 minutes ago and she is extremely upset but they plan on moving close to be able to visit

Did you see on U.S. TV they were saying how big a blow this is to Mexican drug-trafficking....yet ABL has not been in the game since 2008 and never a capo.

Chivis correct me if I'm wrong but I thought in at least one indictment it was written that he was responsible for major loads to the US late in his Mexico incarceration (2012 or 2013) something like that. I find it hard to believe that they would just punish him for his brother ABL and although many may have more info on it than me, the Feds obviously have a lot more info than even insiders. I'm not saying I'm 100% right, but I would be willing to bet that even though the sentence is heavy, the Feds have at very least, the minimum required evidence (quantity of product shipped) to put him away for life.

Delete@3:28 Could you verify via U.S. gov channels, or any open domain sources, that Alfredo (I assume Alfredo Beltran Leyva) was allowed calls on the day you claim? I only ask because I once verified a relationship with someone via the internet and everything checked out (they even had pictures with the "target") however they lied about one thing: haven spoken with the person on a important court day. I was able to verify that the person sentenced was not allowed calls. I just want to know if one could very Leyva was allowed calls.

This is what I can say, the first thing I told chivis I will only talk about what alfredo says I can he is extremely careful he and I have a huge amount of trust. I care about our friendship more than anything else. His family is my family vice versa. I have been followed by dea, FBI. I had to turn over my assets and banking information and pay stubs to make sure I'm not making any financial gains. I did all that to be able to visit him.... I just got off the phone with alfredo at 10:25pm he wanted everyone to know he is putting a appeal in immediately but he is going to be fine and thank you to everyone that cares and has been keeping up with his case. I will try and get him to say a thank you on a voice memo so chivis can put it up
