Alfredo "Mochomo" Beltran Leyva set to be sentenced in D.C. today

Chivis Martinez for Borderland Beat *Big thanks, once again, to Narcomics!*

Alfredo Beltran Leyva will have his sentencing hearing today in a Washington DC Courtroom.  It is set for 2:30PM.

The U.S.  is asking for a life sentence.   The court found that sentencing enhancements asked for by the U.S. are applicable.   The government also asks that his guilty plea result in no sentencing credit for his accepting responsibility.  This is based because of  his filing to withdraw the plea.  The filing to rescind was denied by the court.  This means that although he is not permitted to withdraw his plea, so in effect he is pleading guilty, the U.S.  wants no credit be awarded when calculating sentence.

In the sentencing process, various credits favorable to the defendant, and enhancements  which  give weight to a greater sentence, are calculated by using a number scale.  Refer to the image below to view the U.S. contention of how  they determined a life sentence was in order with a tally of 50.

One of the enhancements is the contention of cartel leadership.   When he pleaded guilty, he was questioned by the judge regarding leadership role.  He was clear that he was a member of BLO, and worked for his brother Arturo, but he was not the leader.

In his recent   evidentiary hearing testimony was presented as evidence.   However it was two agents who simply recited information given to them by  3 cooperators.  The agents testified they were simply repeating  what the cooperators said, and presented no evidence to validate the information.

The cooperators themselves did not testify, nor sworn statements offered from the cooperators.

Alfredo has asked the court for a sentence of 25 years.  He was 36 years old at the time of his 2008 Mexico arrest.  He has been incarcerated continually since that date.

An appellate attorney has been  brought into the case in preparation of the appeals process.

  1. I'm guessing atleast 30 years sentence.

  2. Let's hope justice prevails!
Imposing a lengthy sentence would be appropriate here. And for all those of high caliber status.
Unfortunately laws for detaining and extraditing Mexican government officials are not permitted.

  4. I wager he will get a mandatory life sentence. This will be Chapo's precedent when they will run consecutive all his mandatory life sentences after he is convicted. Bye scumbag enjoy your stay at ADX Florence. Remember that once you die there the US government has deportation orders for your satanic corpse. Your body will be deposited at the US Embassy in MX so they can take out the trash.

    2. 4:06 La Mochoma and matter of fack all the narcas, could get released very soon if they organized to fight for themselves,
Just by threatening to sing all they know about US and mexican governments involvement, and not in taking kickbacks, but on being at the top of it and taking the lion's share instead of believing pendejadas like "the biig baad narcos are too much for the melitary and poolice corporations"

    1. It is a formality. Like when bail is set at 1 or 2 million dollars for unemployed defendants. The courts know that the defendant cannot pay the amount, hence the court can impose their will freely.

  15. His lawyer collected money and sold him up the river.. If your facing life, why plead guilty to life? Im going to tell you why, his lawyer collected his money, sold him a dream like all lawyers do, and then when it was time for trail said i think you should plead guilty, his lawyer didnt have to prepare for a thing.. Welcome to feds..

    1. Yeah well that lawyer might have to watch his back for the rest of his life

  16. This court stuff is dumb! Although he was a known trafficker, they don't know how many kilos he had crossed to the US. Over 450 kilos was just used to get to the 38 points but I doubt they have any real hard evidence of the amount.

  22. I spoke to alfredo last night and the main reason he got the time is because he refused to turn on chapo regardless of the so called feud. Most people on here will say I'm lying but chivis will know who I am he's confirmed my relationship with him. Theirs a lot of information that alfredo had that the US wants. But this is definitely one way to pay for the "bullshit border wall" trump wants. Alfredo was expecting to get life but wanted 25 he's in great spirits his wife called me 30 minutes ago and she is extremely upset but they plan on moving close to be able to visit

I was going to call you today...maybe we can chat in a couple of days.

Yes you are legit...a pal of ABL. relationship confirmed. and a damn good story, BUT I chose not to publish as to not put anyone in harms way. I will email you..... Paz

    3. I've been good all is well over here I went to Mexico in January for a few weeks to visit I met with some pretty interesting people some in which you have written articles about in the past. I was expecting it to be hostile and really bad but it was totally oposite. Your more than welcome to call me at any time. I've found a lot of information out about this case that I was kinda confused about. Which is why I have been under the radar

    4. He must have and still hold alot of Respect for Chapo

      Delete
    5. Why not go to trial? Anyone Federal lawyer would have told him that with relevant conduct he would get life no questions asked..By pleading guilty you have no right to appeal.

      Delete
    6. "J"...good! be careful and anytime you want to run something by me that helps with security just email me.

The case is a joke. and the sentence even more so. less than 1/3 of ONE PERCENT of drug crimes result in a life sentence. plus he pleaded guilty! I will call you, one thing I have learned is who to trust and who to not... BTW I have a theory of why he was made an example and why the massive forfeitures as of late.

Did you see on U.S. TV they were saying how big a blow this is to Mexican drug-trafficking....yet ABL has not been in the game since 2008 and never a capo.

BTW they had Hector's arrest foto on TV jajajaja....oh well..

    7. Chivis correct me if I'm wrong but I thought in at least one indictment it was written that he was responsible for major loads to the US late in his Mexico incarceration (2012 or 2013) something like that. I find it hard to believe that they would just punish him for his brother ABL and although many may have more info on it than me, the Feds obviously have a lot more info than even insiders. I'm not saying I'm 100% right, but I would be willing to bet that even though the sentence is heavy, the Feds have at very least, the minimum required evidence (quantity of product shipped) to put him away for life.

    10. @3:28 Could you verify via U.S. gov channels, or any open domain sources, that Alfredo (I assume Alfredo Beltran Leyva) was allowed calls on the day you claim? I only ask because I once verified a relationship with someone via the internet and everything checked out (they even had pictures with the "target") however they lied about one thing: haven spoken with the person on a important court day. I was able to verify that the person sentenced was not allowed calls. I just want to know if one could very Leyva was allowed calls.

    11. one can't get a better verification than the one I used.

    14. 2::42 there was no reason. I already had an indisputable best verification source. period. It went both ways, because "J" did not know about my sources either. In a way it was comical because we were both proven to be authentic in what we said.

    3. I would never do it without being authorized. "J" can tell you that is the deal. But it is on my bucket list, I just don't want it to be the last thing I do on that list....

No one is talking about the other angel to this story...Hector and Mochomito....

      Delete
    4. This is what I can say, the first thing I told chivis I will only talk about what alfredo says I can he is extremely careful he and I have a huge amount of trust. I care about our friendship more than anything else. His family is my family vice versa. I have been followed by dea, FBI. I had to turn over my assets and banking information and pay stubs to make sure I'm not making any financial gains. I did all that to be able to visit him.... I just got off the phone with alfredo at 10:25pm he wanted everyone to know he is putting a appeal in immediately but he is going to be fine and thank you to everyone that cares and has been keeping up with his case. I will try and get him to say a thank you on a voice memo so chivis can put it up

      Delete
    5. "J" I can verify that being placed on his visitor list is very difficult. i think you were only 1 of 4 or 5? When you first contacted me, well I was happy it was me, most people would have blown you off... lucky I was in a position to have sources that could confirm your story. and what a story. at least I know the story!

eduardo filed a notice of appeal already. I posted it on the post above this one. Laters. It is going to be tough. Laters.... Chivis
