Main suspect in Iguala missing students case, has charges dropped after his human rights violated

Last year the case of the 43 missing students took a big hit, when the 22 Iguala municipal police charged with kidnapping and delivering the students to Sidronio Casarrubias, (leader of Guerreros Unidos), successfully gained injunctions.  The injunctions require that prosecutors acquire greater evidence against the suspects, and explain the inconsistent testimony of witnesses, or the 22 will be released and charges dropped.  It is expected they will go free.

The latest action in the case is a even harder to swallow.  Even by Mexico standards.  In an appeals court Mexico was forced to withdraw charges against Casarrubias, who was the key suspect in the case and was charged with ordering the September 2014 killing and incineration of the 43 students.

The killer’s suspect’s “human rights” were violated

The First Criminal Collegiate Court in Toluca found five violations of human rights, and ordered the charges against Casarrubias revoked.  The evidence in the case was deemed “invalid” because the suspect’s claims of being tortured by police and prosecution agents before his formal statement, was ruled valid.

Just like that….charges for taking the lives of 43 young students, disintegrate.

What comes to mind is the long list of human rights violations found against Dr. Manuel Mireles, autodefensa leader, when he was arrested.  Yet the political prisoner still sits in a prison cell awaiting his date with “justice”.

Former Iguala Mayor José Luis de Abarca and his wife, María de los Ángeles Pineda Villa, were also charged in the case, but it was always my position that in this limited scope of criminality, they were in fact not guilty.  They are guilty of great crimes, but not this one.  I don’t think they were needed and it was as simple as that.  I had written about the case that should have been brought against Abarca, and that is the case of Arturo Hernández Corona, social activist, who according to eye witnesses Abarca shot and killed.  


On the day before the murder, in a public forum, Abarca and his wife threatened Hernández, Abarca saying. “stop fucking around with me, I have people that work for me, that can take care of this”. 

The next day Hernández and 7 others were accosted while driving on the hwy and taken to farm fields.  Abarca drove up with a woman in the vehicle.  The woman never exited the vehicle, and although witnesses could not be positive, she was thought to be the mayors wife.  The witness who gave testimony was one of two of the kidnapped, slated for death, but escaped when the sicarios became drunk and sloppy. 

Before pulling the trigger Abarca taunted Hernández saying, “I told you to stop fucking with me, now I will take pleasure in killing you.” 

Case ignored

Nothing became of the case, not after a Mexican priest, activist Saltillo Bishop Raul Vera, went to Washington DC  to testify at the Commission of Human Rights about the case, and not after Amnesty International became involved and petitioned the Federal Government to intervene in the case.

Not until months after the disappearance of the 43 students, was attention paid to the case.  Abarca was then charged with the murder.

At the end of it all, a few of low rung narcos will do a little time, but the 22 police, G.U. leaders, the mayor and his wife will probably be cleared in the case of the students.

Attempting to gain some credibility, prosecutors said that although the charges are dropped against Casarrubias in the case of the 43, no worries, he won’t be released just yet; he faces charges of weapons and drug trafficking charges.


I am sure that makes everyone feel a whole lot better.

Comandante Perro, sidronio no mató a los estudiantes, fué el gobierno federal, quieren cerrar la escuela de guerrilleros de ayotzinapa porque ahi hay oro y uranio, even George Soros helped the murderers of Acteal-Chenalhó win their appeals and freedom to go back to chiapas because there is gold in them thar heels, but bad as Sidronio and the imperial couple de iguala are, the 43 disappearances was all on the mexican army and policias federales, check your facts, perro...

    1. 12:45 if they allege they were tortured and forced to confess and they said it right away when interrogated by the PGR and it was observed that they were tortured, of course, they go free, pending other charges, even the abarcas will be exhonerated, of the 43 disappearances, but not from other crimes, like the murder of arturo hernandez corona...

    2. It would make sense that no confession could be used as evidence that was obtained by torture . Any criminal can claim evidence was obtained illegally . I think the has to be some proof of it being obtained illegally .

    3. You've got to remember human rights are only valid for those who the government and court's say they are. If there's any doubting that just ask Dr. Manuel Mireles I'm quite sure he'd be able to write a book on losing one's human rights. If the Mexican people ever want to actually have a government by the people and for the people Mexico is going to have to go through a long and bloody transition but it can be done.

  5. Is there such a thing called "Justice" in Mexico? I mean really. I know all countries have their issues but come on. The Phillipanes and their judicial executions for drug crimes is the only country worse off than Mexico at the moment IMO. But hey at least the citizens are happy.

      Testimony acquired by police illegally is called "the fruit of the prohibited tree" and thrown out of court.
      Of course, this is not quite the case here, but a smart lawyer used the principle in Mexico.

Smart lawyers do not matter in mexico, family ties do, and since the investigators ain't found nothin, and since the case is cooold, it follows that the mexican government that was the ones that did this crime, is releasing their puppet fall guys one by one, they got US billions of dollars and weapons to prove who your daddy and do as they please, aaight?

  11. This disgusts me so much. Why is Mexico like this???

    I don't want to criticize another country given that the US has so many problems as well (We allow powerful people like Hillary Clinton to also avoid justice), but who is this nobody to be able to escape justice like this? I want to vomit.

  18. Does any of this REALLY surprise anyone? This is Mexico. It's corrupt from the President down to the people. Basically it's a failed country and people. The real surprise is that some people can't see the truth.

    2. I grew up in PG County, which shares a border with Washington DC. The police in PG have a reputation for getting people to confess to crimes they didn't commit. Of course the people who confess are poor and can't afford good lawyers. And this is happening right next door to the US capital city. Brutal, incompetent policing is not just a Mexican problem. And we've got M13 here in the DC suburbs, so violent gangs are not just a Mexican problem.

      Mexico is not a failed country. The economy is stronger and people are better off than they were 20 years ago. The government works reasonably well for most people. But the criminal justice system is too weak to deal with gangs strengthened by money and guns from el Norte. Blame the political elite for that, but not the country and the people.

    2. Too true! But you forgot someone. The majors' wife. And then, there is the actions of the students themselves. Commandeering buses is not always the best way to make friends and influence people. I think they really fucked up when they unknowingly stole the wrong bus..

    3. 1:15 the bus full of monarch butterflies? That is just another invention of the mexican pgr, the capos would just shoot up anybody in their way and recover their drugs, they do not trust anybody with the money or drugs.
      --Governments all over the world are trying to make transnational corporations happy and murdering their people, mexico is not to be an exception, ayotzinapa is on land mining companies want for the gold and the uranium, plus it is a school where the favorite extracurricular activity is to.criticize the mexican government and taking no BS from anyone, even now, the elite lawyers from the mexican government with their university education, debating skills, and experience as very polished liars and "parlamentarians" can't match the ayotzinapa students because the ayotzinapos have the truth on their side.
      --Read "La Guerra Que Nos Ocultan" do not be left outside in the dark and ignorant...
