Judge put the lid on names of cooperative witnesses in El Mochomo Trial

Last week the court made public a ruling against Alfredo “El Mochomo” Beltran Leyva, regarding  several motions he filed with the court 5 months ago, including the request for the identification of cooperating witnesses be made available to him.

The case against Mochomo has some peculiarities noticed when reviewing transcripts, motions and other filings.  For one, there was only a bare bones indictment filed against him after his extradition was approved. He was not a part of the long standing indictment against his brothers and other BLO membership. 

Secondly, the evidence against Mochomo, is mostly based on the expected testimony of cooperating witnesses, who they themselves have been known to engage, in the same criminality that Mochomo has been charged with, and one witness is known to have been the leader of an enforcement group. 

The following was included in the motion filed on behalf of Mochomo:

1. A review of the discovery generated to date and representations by the government indicates that the overwhelming majority of evidence to be presented at trial is derived from confidential informants.

2. Witnesses who have provided information to law enforcement did so after they were either charged or told that they would be indicted unless they agreed to cooperate.

3. Mr. Beltrán Leyva seeks to interview each person who gave information to law enforcement who falls within the category of confidential informant regardless of whether they will be called to testify at trial.


4. The confidential informants used by law enforcement may be biased against Mr. Beltrán Leyva.

5. The identities of the informants are necessary to the defense in order to investigate bias motives to fabricate and to cast doubt upon the credibility of certain witnesses.

6. Mr. Beltrán Leyva seeks useful and relevant information that cannot be learned without a disclosure by the government. There is no reason related to security to withhold this essential information. Mr. Beltrán Leyva’s due process rights mandate pretrial disclosure of the identities of each confidential informant who has provided information to law enforcement.

7.  Because there is no physical evidence linking defendant to the conspiracy, the United States has had to rely upon individuals actively engaged in criminal activity and individuals seeking compensation as the means of structuring the indictment herein.

Argument:

Without disclosure of the informant’s identity and the ability to interview the informant or call the informant as a witness, Mr. Beltrán Leyva might well be forced to testify in order to try to establish that he had a lack of knowledge or intent. Where the informant is a participant and material witness to the crime charged, as is applicable herein with respect to certain government witnesses, forcing Mr. Beltrán Leyva to testify or depriving him of the right to interview or call such a witness constitutes a denial of fundamental fairness, and violates both his Fifth Amendment right to remain silent and his Sixth Amendment rights to confrontation as well as to effective assistance of counsel.

If the defense is not alerted to the identity of these witnesses in sufficient time to conduct a thorough investigation, Mr. Beltrán Leyva’s right to confront his accusers will be severely prejudiced.

1.  Defendant requests a weekly hair trim and shave, during his trial

2.  Defendant requests permission to wear street clothes during the trial

3.  Defendant requests sack lunches be varied instead of the 2 pieces of bread and cheese

Apparently, he had concerns of constipation.

      i don't understand the point, what difference does it make? once they are on the stand everyone knows. even before. no one twisted an arm of these "witnesses" they went into it asking for a sweet deal. If you know the history of mochomo, the witnesses are as bad or worse.

      I am not opposed to government witnesses, if there is ample evidence to prove the charges, and if the witnesses are not a group of badguys that took years and millions to bring to the US to prosecute, but it looks like there are several that will be testifying because they have so little evidence. He, even today, does not have an indictment, not a real one, just a boiler plate grand jury 2 page nonsense. No particulars are in the 2 pages. i THINK WE are giving up too much. Plus they are charging him with drug conspiracy for the years he was incarcerated in Mexico.

I was just thinking of safety of the witnesses.There have been cases[although rare]of witnesses being knocked off before testifying in a Mafia trial.Maybe it isn't fair to the defence as they need time to prepare a defence or maybe they are just gung-ho to prosecute.I wonder how long this trial will last with defence having very little time to prepare from the secret witnesses.Please keep us updated on not just the details but your opinions on things as to what is normal or not in this trial.

    The lawyers for El Mochomo just need to read Borderland Beat about all the searches you guys did on the B.O.P. websight trying to find the Zombadas and Chino and all the other inmates to no avail. Borderland Beat did all the work in finding the witnesses.

      After Mamito testified against the trevinos in the race horse money laundering trial. Aftr it was said and done I heard a rumor that Mamito was in Tamps. I searched for him in BOP and he was gone. I surmised he was in WP serving whatever deal he cut.

      Latr I began searching all the Sinaloa players and asked Siskiyou kid for help. They were all out of BOP. we know they are not in Marshalls custody because that is used only pretrial. Rumors of Vincente and El Rey were going to testify against mochomo.

      I don't place value on witnesses that are enemies, that is ignorant

    3. I did think of La barbie and how fast he lead guilty. but three months before trial is cutting it close. But its a possibility, and who would know more? But the point is all the evidence is cooperative witnesses who are incarcerated, I wonder what was so valuable about mochomo that the state gave up so many to prosecute him, by giving light sentences. Think of the years of gathering intel and searching what that cost was....VZ makes sense because he had so much against DEA. But the others? But we don't know for sure who and how many. I can't see it is the flores twins. but anything can happen.

      Poor Mochomo! afraid the cheese sandwiches will constipate him :) That was the funniest motion I have read in a long while. (motion for relief)

      back to Barbie, he began snitching long before his arrest, so it is feasible his deal was sealed with info he gave prior to extradition.

      I learned a lesson from the Zetas trial. Fed Prosecutors are over zealous in some high profile cases. in the zetas trial one found not guilty, another exonerated on appeal and other got a new trial. and they gave sweet deals to a few bad guys in that trial. including Mamito

    they are not allowing him to wear street clothing, he must wear prison jumpsuit

    he is denied weekly hair trim and shave

    his cheese sandwich/constipation fear is still under consideration

    a couple hearing transcripts are unsealed today, they are not up yet but when they are I will take a look and see if there is anyway interesting. trial will begin on a week from today on the 16th

    EL Chapo's FIL was also arrested but the U.S. has no extradition request for him. That is surprising, as he headed trafficking through Sonora to the U.S.

  34. My guess is La Barbie provided testimony on his activites in MX and the Flores Twins are providing intel on the US side of the business. The Zambadas don't have incentive to turn on the Beltran Family, MZ didn't want problems with them. The Guzman clan is said to not have problems either. Could it be EPN and his buddies in el DF, de Gortari and the Lebanese guy wanted the Beltran Clan out of their "territory"???
