Dr. Mireles will remain in prison, after losing motion to dismiss

Note: Attorneys filed the same argument in the case of Doctor Manuel Mireles, as in the successful argument of Cemei Verdia, the coastal (or genuine) autodefensas leader, who was released from prison, after winning the motion to dismiss.

The argument put forth, was that there was not only knowledge of weapons being use by autodefensas groups, but that it was done with the consent of authorities, including Security Chief of Michoacán, Alfredo Castillo.  Furthermore, the argument stresses that many operations by federal forces were organized and conducted with autodefensas.  This was especially true in the sierras.  The rugged, and logistically challenging, federal forces depending on autodefensas to navigate the mountain terrain.  Despite having the exact argument as Verdia’s motion, Mireles’ motion was denied.

Federal District-- The 5th District Court denied the dismissal of charges against Jose Manuel Mireles, former leader of the Michoacan self defense forces, incarcerated since June 27, 2014.

With this ruling, the activist must continue his trial from the federal prison in Hermosillo, Sonora, charged with violating the Federal Law on Firearms and Explosives when he went in with other self defense forces to take control over the security in the town of La Mira.

"The Motion to Dismiss the ongoing criminal prosecution, brought by the defense on behalf of Jose Manuel Mireles Valverde, is not well founded," reads the judge's ruling.

Ignacio Mendoza, Mireles' defense lawyer, had requested the dismissal of the case based on the argument that the law did not apply to his client.

According to Mendoza, Mireles acted with de facto authority from the Government in carrying out public security functions during a moment of crisis caused by the presence of organized crime groups who were destroying several regions of the state.  

He felt that the ones who should be in prison are the authorities who made pacts with armed civilians, registered their firearms and carried out joint patrols with them.

"We all saw that (former federal commissioner for security in Michoacan, Alfredo) Castillo not only negotiated agreements with the self defense forces, but carried out joint patrols with them, registered their restricted use firearms and afterwards gave them official weapons," he charged.    

The former Deputy Prosecutor for the State also announced that he will appeal the judge's ruling.

Governor Silvano Aureoles announced the ruling even before Mireles' lawyer was notified.

"I understand that, once again, the ruling went against what the Mireles defense had asked for," he commented in an interview during the inauguration of the new State Public Defense offices.

The PRD member admitted that the matter of incarcerated self defense (personnel) needed to be reviewed.


"That's another chapter, that when the normalization stage is done, we will have to see what we can do with many [individuals] who are very probably innocent (yet) are in  prison," he stated.

U.S. has most users and i'm sure there is all kinds of mafias running around in U.S but they know not to go around like Mexican mafias. I read an article here in BB how the Sinaloa cartel, the Beltran Leyvas, and Juares catel all lived in a community in Texas but had a truce not to kill each other there,why? they know they wont get away with it like in Mexico ..   5. I understand the reasoning for the need of Autodefensas, but is it really the best solution to counter cartels and/or lack of law enforcement?

    Honestly, seems kind of like.. "The hobbit: Battle of the five armies"

    Is everybody armed & aiming at each other for different believes, causes, reasons etc... Sounds like genocide to me.

    Lets face it, Mexico seems hopeless for the foreseeable future...

  10. No matter what his motives he his guilty of the ultimate crime in any truely corrupt and criminal society. He encouraged the people to arm and stand up to their oppressor's. While a criminal political system will allow, as long as they get a cut, any other crimes against its population they can not allow the people to stand up to local criminals since they might get it into their minds to challenge the ultimate criminals running the country.
    In the US a constitution was adopted, fresh from a revolution against the strongest military on the planet, theat contained the bill of rights, allowing the citizens to arm themselves. The political left has been trying to suspend that right ever since.

I don't see how Peña Nieto justifies spending millions to look for one man and the missing 43 are an after thought. Track the daily routines of this judge and SHOOT HIM. Track Alfredo Castillo and 20-30 of you shoot him...cant catch or point the finger at everyone. I know it sounds a bit sissy but, historically against a government a passive resistance and civil disobedience is more likely to create change over violence or revolution. Against the cartels the comunitarios did the right thing. Civil disobedience will never work against the cartels. The only way is to kill the bastards. Peaceful marches and organization will get the world attention. Once that happens change will slowly come. You cannot solve violence with more violence. Just look at the Middle East.

Turns out she had an old man decapitated because he owed her money. The old mans 7 year old grandson witnessed it so they decapitated him as well.

  37. Rumor has it that it might have been the AD's. A form of street justice?? One thing to note about that area is that there are a lot of very rich powerful families. You might have an idea how they made their fortunes. They were there before the CT's and they are there now. They are part of the economy. Everyone benefits from the drug money. Unfortunately these families now fund the AD's. A lesser of two evils. AT least now the average folk is not getting taxed by the CT's.

Bottom line is that Dr. Mireles was the first to initiate a stand against the senseless violence from the drug cartel & crooked police, officials, etc. He did what was needed when no other options were available. He fought back and gave the local communities a fighting chance against the most ruthless pigs on the face of the earth. Sadly, some of those who were with him in the beginning, gave in to the pressure from the government. He is their example to dissuade others from trying to do the same. He had the courage to stand up against the overwhelming odds, even at the end when the government had not taken a single step to arrest any of the cartel he was fighting against. Mexico has now become the most dangerous country on the planet. I salute Dr. Mireles for having the courage to do what no other has ever attempted. If ever a rescue mission is needed, this is it, unlike what happened for El Chappo.

I'm a internet marketer and maybe creating a marketing campaign online to Hispanics and Mexicans is what we should do to bring awareness to this hero. It's time for change and luckily for us we now have the internet where we can come together and start asking the right questions. Like what can we do as a society to help this man get free

  43. From what this man tried to accomplish is brave and in a sense what that country needs. I have traveled to Central America and have seen the poverty level and way of life and it is a shame that people who barely have anything have to fear loosing the little they have or their life at that. The Mexican government is corrupt obviously and need to free this man but the sad part about it is that he will most likely be murdered at the hands of the government or never released.

  44. Like the 2nd amendment here in the US, The Mexican constitution says that the people have the right to keep and bear arms. Corrupt politicians in the 1970s stripped away that right and here we are. No one would argue that you have the right to defend your family; that is an inalienable right that is part of natural law and recognized in the US by the constitution and common law since the Magna Carta. In Mexico you will need to sharpen a toothbrush or something because thats how effective you will be against the criminals that run things there.

    They may have locked up Mireles but ultimately you can't kill an idea. Someday, with the right leadership, Mexico will get both Mierles and their Article 10 right to bear arms back.

  50. Watched the Cartel Land documentary on Norwegian TV yesterday, and i really hope Mireles is free now or will be free soon. I admire him for what he did. When the rulers did't mind the tragedies that were put upon the locals, even the killing of small children, someone had to do something to protect the people from the brutal criminals.

His story needs WORLD WIDE attention to at the very least ensure he is being treated humanely. Somebody needs to do something, ANYTHING.   52. This is a terrible shame by the Mexican Govenment to have put this man in jail. Of course I have seen the documatary on TV here in Canada last night. What else could have been done under the situation in the towns in that part of Mexico. The people were being murdered by devils who had been murdering mothers husbands sons & even babies. Drug Cartels or ISIS the same fate they deserved as there was no Government intervention to help. FREE THIS MAN.
