Dr Mireles Laughs and Cries, When told of the Outpouring of Support

There have been a few rumblings that Doc Mireles did not live up to his April agreement.  His friend Hipolito Mora has said as much, although he  is in support of Doc.  As I recall Lito was in prison when the April meeting occurred, and not at the meeting.  I had a conversation with Dr. Mireles the day of the April meetings, because I read in some publications there was an "agreement".  He stated; nothing was signed, and the meeting was to clarify expectations, from both perspectives as the government May deadline loomed near.

 His position was the same on that day as it has always been.

He was ambushed in a unilateral move by Smurf after Doc's EL PAÍS interview, where he stated the agreement was all theater.

Mireles was recovering from the plane crash in Mexico City, when he gave the interview, and Smurf, who is his former body guard, removed him from his spokesman position without a vote. 

With respect to the April meeting, here is his reply to me, in part, about the significance of the meeting:

"Todo esta bien. Solo hemos ratificado nuestra postura de no al desarme hasta que:
1 se limpie  el estado de Michoacan de criminales
2 se restablezca el estado de derecho con una real seguridad publica y una justa imparticion  de Justicia.
Y
3 liberación de los autodefensas presos.
Todo esto debe hacerse en 30 días.
(Hasta el 11 de Mayo)" 

(All is well, we just reaffirmed our position not to disarm until
1.  Cleaning of Michoacan of the criminals
2.   Establish public safety, and fair administration of justice
3.  liberation of imprisoned autodefensas.
This must be done in 30 days by May 11)...(Chivís)

Dr. Jose Manuel Mireles Valverde laughs, cries, gets excited when his attorney Talía Vázquez Alatorre tells him of the outpouring of support he is receiving as a result of his arrest, and he lets out a guffaw when he learns that people are shaving their heads in solidarity. Immediately, speaking with courage and conviction, he recognizes that prison was an expected scenario in his self-defense activity, and he launches his definition of the situation:
"I am a political prisoner."
After federal judge Armando Wong issued the detention order in criminal case 137/2014, Mireles became prisoner number 5557 at the Federal Center for Social Rehabilitation (CEFERESO) Number 11 located in Hermosillo, Sonora. Mireles' three bodyguards, Javier Reyes Magaña, Salvador Mendoza and Gerardo García López Casillas, also received detention orders for the alleged crimes of
"possession of a firearm for the exclusive use of the Army and for crimes against health, in the form of drug dealing in the variant of simple possession of marijuana and cocaine."
Crimes that, according to his defense attorney, are false. In an interview with La Jornada, Talía Vázquez Alatorre relates details of her one-hour visit with her client in prison:
"We are [contesting] the detention order for two reasons: one, for serious violations of due process; and the other, for statements by public officials that place him as a political prisoner."

Dr. Mireles' defense team is preparing the amparo [protection; i.e., injunction] and an appeal [of the detention order] in parallel with a complaint filed with the Inter-American Commission on Human Rights (IACHR):
"We have 15 business days to go against the detention order, while the legal process continues, but we intend to get to international bodies like the Human Rights Commission, where we have already begun the process." Alfredo Castillo Fails

According to the legal file of the arguments for resolving Dr. Mireles' legal status, to which La Jornada has had access, attorney Salvador Molina Navarro makes a plea for obedience to the law and justification of self-defense based on an analysis presented by academic Jaime Cárdenas, who argues that the defendants' "are not legally responsible" given that they belong to a social movement known as the self-defense groups of Michoacán.

The defense team believes that Dr. Mireles and his three bodyguards are victims of an "illegal detention," which was carried out without an arrest warrant and without being about either a case of flagrante delicto[caught in the act] or emergency, which contravenes Article 16 of the Constitution. They argue that Dr. Mireles Valverde suffered "acts of torture"; that the judge was negligent in failing to investigate the facts; plus Mireles was not allowed to make the proper telephone call to a defense attorney within the legally prescribed time period and, finally, that the "evidence" presented by the authority was "planted," which makes it both false and illegal.
A nod to Doc Mireles' comment "I was armed with a chicken leg"
They point out that the 55-page text of the arguments on behalf of Dr. Mireles reads [in part]
 "torture, such as that suffered by the accused, even since his detention, aggravated even more in the person of José Manuel Mireles Valverde, who was blindfolded without either cause or justification and made to believe that they would throw him into the sea, and even preventing the immediate communication that is an inalienable right, voids any and all of the evidence that the Public Ministry [prosecutors and investigative police under their direction] could gather in the investigation phase." Among the arguments presented is that of appropriate and collective "legitimate defense" due to the fact that the government has not assured security in Michoacán:
"Hence, given the lack of legal security provided by State forces, society finds itself in the state of necessity. Clearly reflecting the lack of legal certainty in which residents of different sectors of the population find themselves, they feel vulnerable to attacks by organized crime on their integrity, both tax- and property-wise [not only does organized crime exact 'fees' (taxes), but seizes properties outright]. As a result of all this, and in response to an attack on their physical persons and property, they find themselves in full need of collectively defending themselves and their property. From this follows the behavior used to safeguard the peoples' assets by their taking possession of all feasible means of defense in order to repel their attackers' aggressions.
Defense attorney Vázquez insists that Dr. Mireles is a political prisoner because public officials like Alfredo Castillo, Commissioner for Public Security in Michoacán, and Miguel Ángel Osorio Chong, Secretary of Government Relations, have declared that the detainee is imprisoned for not having complied with the agreements concluded in the month of May.;

Attorney Talia Vázquez explains:
"The one who never complied with any of the agreements was Alfredo Castillo. He neither freed the imprisoned 517 members of self-defense groups just in Michoacán nor did he release Hipólito Mora before May 10. Above all, he neither achieved the arrest of La Tuta nor did he restore the rule of law. Nothing happened. Who broke the agreement was not Dr. Mireles but Alfredo Castillo. This also demonstrates that Mireles is a political prisoner."

  12. The arrest of Dr. Mireles only confirmed that the Mexican government is totally untrustworthy and unscrupulous but karma has a way of fixing things. The incarceration of Dr. Mireles has made the Mexican public as well as the cartels open their eyes to notice what kind of people are running their government. Who in their right mind is going to want to make any deals or agreements with the likes of EPN and Castillo who are not persons of their word. They will smile at you while holding a dagger behind their back to stab you while your back is turned.

  13. About the fund raising....He is not asking for money at this time. His attorney says there are Fake Funds out there, supposedly for him, but it is nothing they know about.

    so please beware. Maybe later, I imagine his defense will be costly, most of the attorneys are pro bono, but that is small compared to what it will take. I would imagine

I dont know how all crime can be vanquished, I mean little bullshit offences are of no concern, but it is a good sign that the congressional deputies are showing their support, that usually means that he has the support of those that actually do the legwork inside the governmental machine, I just dont understand how this can have gone on for so long, why is the govt that jailed him trying to buy time..

  22. one of the reasons Dr Mireles was arrested was for having "bank accounts" documents with a different balances on them which proves that he was in posession of bank accounts....
    money which will be, it it has not been already, confiscated, mexican police style.
    --mexican government need to be shown all of our hate and repudiation at the international level, because in mexico it is almost useless, in spite of not having any teeth, the international human rights commission still tries to show a respectable face, they know they can't cover the sun with one finger anymore, i dream of the day el castillo de cagada apologizes, to tell him to stick it up his ass, i don't know if a lawsuit can be filed for abuse of authority in mexico, but this case, the hipolito mora's case and many others illustrate the need, also there is a need for mexico's supreme court of justice to be divorced from the executive branch, i don't see any reason for every new president having the chief justice and he court that he wants selects and appoints, along with the legislators that he choses to carry his presidential puppeteers' agenda, like videgaray's...through total totalitarian corruption.
    we need to elect our own government in exile and have a new constitutional convention, after all we have many mexican lawyers working as dishwashers in the US, even engineers and doctors...

  24. Doc M did not have various bank accounts with money. Don't believe the hype of castillo. He was broke. When Casillo took his armor car away he purchased one on credit but the payments were steep, over 4000K per month, and he was already a month behind when arrested.

    like the planted weapons and drugs, there was a plan to assure he is incarcerated many years. The "suspicious" bank accounts were already alluded to within a few hrs of his arrest.

  36. I am working on it. I don't want to do anything that may hurt him so I want to get some guidance. It would be a legal and personal expense fund. Ir just legal fund. I know he was really hurting financially before his arrest and did not think he would be able to keep his armor car.

I am hopeful for Mireles because of the huge missteps the Mexican federal government is taking, these PRI lords are so used to get away with anything that they act as if they were the caciques of some isolated town in the mountains, not realizing the times have changed, their grip on the national media is not as strong as it used to be and they have no control at all of the flow of information through the internet, they can´t do whatever they want and still keep it a secret, they can´t incarcerate or kill the leaders of all the social organizations that have appeared in México in the last years and hide it from the general public, and if there´s something that scares EPN is negative attention at international level, which is what he is getting now in big doses, let´s keep on spreading the word! The more attention the true side of the story gets worldwide the sooner Mireles will be released when the Mexican government feels watched and forced to follow the law. Thank you BB.

  40. Bravo to Borderland Beat, for covering the dramatic, unfolding story of Dr. Mireles and the autodefensas, and for posting regular updates about Dr. Mireles. This is a big story, however most news outlets north of the border still aren't following it. The more attention brought to Dr. Mireles' story, the better. Borderland Beat is doing its part. It's up to the rest of us to keep spreading the word, and raising public awareness about the courageous Dr. Mireles and his men. They are genuine heroes at a time when many people have lost all hope. Viva Mireles!

    castillo took away Mireles amor vehicle which left him extremely vulnerable.
    he then said mireles' escorts could not carry weapons.

    a group of supporters about 20 or so pledged to fund the vehicle. I can't recall the price .

    --the answer is YES! of course, even el pri members don't believe much anymore, after stealimg pemex to give it away for peanuts, there will not be much for the mexican politician to steal, to get kickbacks from, i womder if cementos de mexico has been sold away too?
