Garcia Luna's Motion To Dismiss Drug Charges Denied

The request by the defense of former Public Security Secretary Genaro García Luna to annul the charges of drug trafficking has been denied.

According to information reported by El Dictamen, it was last Saturday that the U.S. Attorney's Office decided to reject the request of the defense of the former Mexican official.

The former official's defense had requested that the drug trafficking charges be dropped, arguing that it is clear that his client did not commit acts of conspiracy with the Sinaloa cartel.

Genaro Garcia Luna is since 2019 charged with alleged participation in a continuing criminal enterprise, conspiracy to distribute cocaine internment, conspiracy to distribute and possess, to distribute cocaine, making false statements, among others.

Therefore, his defense has pointed out that if the former official had participated in conspiracy with the Sinaloa cartel during the years 2001 and 2012, which they claim he did not do, as also that it is clear that when he left public life and Mexico in 2012, he left any alleged conspiracy.

However, the U.S. Attorney's Office determined to reject the defense's request, since it stated that the indictment against the former official covers the period from January 2001 to July 2021.

  1. Good news, though I'm a little confused about the legal repercussions of this in the US. If a corrupt Government Mexican official who is enabling a DTO is himself charged with actual drug trafficking then the lines between bribed officials and the traffickers will become blurred. It sounds like an attempt by the DEA to set precedent that will allow them, in future, to put pressure on corrupt officials and deny them their usual get out. I bet Anabel Hernandez is in court every day waiting for him to look over at her, so she can wink and wave.

    2. @9.07 I remember reading something similar, but it sounded vague- something to do with routes rather than specific shipments being ignored I think, but there may be way more I haven't seen, cos it was a while ago. The most interesting thing to me was his private surveillance company that had the whole of Mexican intelligence and their spyware and tradecraft at their disposal, all potentially being used against the enemies of Sinaloas bosses.

    He was the head of a antidrug agency that now got dismantled. He and his agency were doing the same thing the DEA does.
    He had a favorite cartel with was cds and killed off his enemies or helped lock them up from some good money.
