US Judge Dismisses Mexico's $10 Billion Lawsuit Against Gun Makers, Mexico to Appeal

A U.S. judge on Friday dismissed Mexico's $10 billion lawsuit seeking to hold U.S. gun manufacturers responsible for facilitating the trafficking of a deadly flood of weapons across the U.S.-Mexico border to drug cartels.

The decision by Chief Judge F. Dennis Saylor in federal court in Boston is a victory for Smith & Wesson Brands Inc., Sturm, Ruger & Co. and others accused of undermining Mexico's strict gun laws by designing, marketing and selling military-style assault weapons that cartels could use.

The main argument was that these companies have promoted "negligent and illicit" business practices that facilitate illegal arms trafficking to Mexico. According to figures included in the document presented to the United States court, each year up to 500,000 weapons are trafficked from the US and, in 2019, they could have been behind around 17,000 intentional homicides throughout the world.

Mexico said it would appeal the decision.

"This suit by the Mexican government has received worldwide recognition and has been considered a turning point in the discussion around the gun industry's responsibility for the violence experience in Mexico and the region," Mexico's foreign ministry said in a statement.

Saylor said federal law "unequivocally" bars lawsuits seeking to hold gun manufacturers responsible when people use guns for their intended purpose. He said the law contained several narrow exceptions but none applied.

"While the court has considerable sympathy for the people of Mexico, and none whatsoever for those who traffic guns to Mexican criminal organizations, it is duty-bound to follow the law," Saylor wrote in a 44-page decision.

Other defendants included Barrett Firearms Manufacturing Inc, Beretta USA Corp, Colt's Manufacturing Co and Glock Inc. Representatives for the companies either declined to comment or did not respond to requests for comment. Lawrence Keane, the general counsel of firearm industry trade group National Shooting Sports Foundation, welcomed the dismissal of the "baseless lawsuit."

  2. It's a good thing that this was dismissed. If it were allowed to move forward, everyone would be suing McDonalds because they are obese or suing car companies because they were hit by a drunk driver.
    Our system is built on personal responsibility. You are responsible for your own actions.
    Everyone has the right to own and operate a car. However, if you choose to use that car to run into a crowd in a terrorist incident, the car company is not liable.
    The radical left is trying to guarantee that everyone will be born, live their whole lives without incident and die after having lived a happy and fulfilling life. But life is not like that. When we are born, out life comes with no guarantees.
    This is just Mexican politicians trying to affect U.S. policy. The U.S. has to deal with gun violence and will deal with it on our own terms. As long as our politicians continue to fail us, we will continue to pay the price.
    Everyone is under the mistaken belief that most of the guns involved in crime in Mexico come from the U.S. This is not true.
    The majority of weapons seized in Mexico that are traceable originate or pass through the U.S. But only a small percentage is traceable. China and North Korea export large numbers of weapons that are not traceable. So does Pakistan, but we cannot determine Pakistan's role because they are the largest producer of homemade firearms that lack a serial number or any other identification.
    Fewer than 20% of all firearms seized in Mexico are traceable to the U.S. and that percentage has been steadily declining. Cartels aren't buying rpg's, antitank weapons and .50 caliber machine guns from Billy Bob's gun shop.
    ELMO's policy of hugs not bullets is failing and ELMO seizes on this issue to pass blame on to the U.S.

Strangely I believe that car manufacturers should be held accountable entirely if their cars kill mass amounts of people simply because I think modern cars are far too quiet that it becomes a health and safety issue. People have the right to listen to music through their headphones as they walk down the street. Should that be stripped away because car companies can't be sued?   10. They have all the reason. It's the same system/ business practice all multinationals use. Tabacco companies supplied Italian/Albanian mafia with industrial loads of cigarettes straight from the factory. So the criminals could "smuggle" them back into Europe.

    Same as with opioids, the Pharmaceuticals supply/generate the grey-markets themselves.

    There is no reason to assume the illegal weapon-market would operate any other way. It is the companies themselves that deliver directly to the criminals. Big companies only want to make profit, any which way. The 1000's of deaths it generates worldwide is none of their concerns.

    They understand that even when they get caught, they will be tried and judged under civil-law (white-collar-law), and not under criminal law.

    So they do their evil with impunity, no sense of responsability. Because the worst that can happen to them is that the company gets a fine. Which will be calculated back to the consumers.

    Keep suing Mexico. Hold the Line

    BB should post these kinds of stories in this link also to remind everyone how some people here in the state of Texas and perhaps elsewhere have often times treated migrants violently sometimes due to anti migrant talk that politicians spew out.
