El Mencho's: Twenty year history in Tijuana

Rosalinda González Valencia, wife of the leader of the CJNG, has acquired properties in Tijuana since 1998. Her daughter, Jessica Johanna, also has a property in her name since 2009. That is why Nemesio Oseguera Cervantes sought an injunction in 2013, noting domicile in this border city. The properties of both women are insured by the FGR since 2017, and are located in Playas de Tijuana. The daughter of "Mencho" was granted in Guadalajara an amparo that frees her from an arrest warrant.

The presence of the Jalisco Cartel New Generation  (CJNG) is not new in Baja California. It has been developed over the last two decades. First with the presence of members of the so-called Millenium Cartel or Los Valencia, who used methamphetamine; and second, with the roots and investments of family members who, since 2012, have been designated as the leader of the criminal organization: Nemesio Oseguera Cervantes "El Mencho".

These circumstances encouraged the growth of the CJNG on the border in the most recent years, initially weaving alliances [CAF/AFO]and then controlling the main territories of Tijuana in a fight against the Sinaloa Cartel and a part of the Arellano Felix Cartel, to the extent that it has already been attributed at least the construction of a narco tunnel and several narco laboratories that supply drugs to California.

ZETA's investigations prove that direct relatives and politicians of the "Mencho" settled in Tijuana since 1998. At least that is how his wife Rosalinda González Valencia and the daughters of both Jessica Jessica and Laisha Michelle Oseguera González appear in the Public Registry of Property and Commerce (RPPC).


The women of the Oseguera family acquired several properties in Playas de Tijuana between 1998 and 2009, some of which were seized  by the Office of the Attorney General of the Republic (FGR) from July and August 2017 on the occasion of the investigations initiated two years earlier  against Abigael González Valencia "El Cuini" and Nemesio Oseguera Cervantes himself, who also calls himself Nemesio Oseguera Ramos and / or Rubén Oseguera Cervantes, among other names.

The commanders who lead the CJNG identified as Tijuana Nueva Generación Cartel (CTNG) are from Guadalajara, although with some experience in this part of the country, which has triggered a battle being waged by its members in both Baja California and Jalisco.

FROM "LOS CUINIS"

Rosalinda González Valencia, sister of the financial operators of the criminal organization identified
as "Los Cuinis" and wife of  "Mencho", expanded her properties and territories after the end of 1998 she purchased a property from Perseo Constructora, SA CV, represented by its administrator Avelino "N" in the amount of 576 thousand pesos.

According to the deed 51156, and Notary Public Number 6 of Tijuana, dated October 19, 1998, the property is located in lot 24-A, block 176, Jardines del Sol fractionation in Playas de Tijuana. It is a property of 250 square meters with construction that borders the West with Crestón street.

Another property that Mrs. González Valencia bought in September 1999, is the one located in lot 8, block 93, Jardines Section in Playas de Tijuana. It is an urban property with 250 square meters of surface, connecting to the East with the Pedernal street.

In accordance with public deed 46689, signed by the Notary Public Number 5 of Tijuana, Mrs. María Asunción "N", with the consent of her husband Jesús "N", both represented by her attorney Miguel Tovar, sold the property to the wife of Oseguera Cervantes in 802 thousand 352 pesos.

It also stands out as the property of Rosalinda and her daughter Laisha Michelle Oseguera González, lot 27, block 11, in the Jardines de Chapultepec subdivision, in Tijuana. The land has 225 square meters and is bordered on the south by Encino Street. Greater information on the sale and purchase operation is unknown.

The last two mentioned properties were seized  by the former General Attorney's Office after a search warrant was carried out by personnel assigned to the Specialized Unit in Financial Analysis, within the preliminary investigation AP / PGR / UEAF / 039/2015 .

With the official letter number PGR / UEAF / DGALF / 2208/2017 dated July 13, 2017, signed by the agent of the Public Ministry of the Federation, Verónica Lara San Vicente, the federal agency ordered the RPCC in this city to settle in the books seizure of  the properties described above. The foregoing was recorded in item 6071048, on August 11, 2017.

FINANCIAL BRAIN

Jessica Johanna Oseguera Cervantes, born on July 23, 1986 in San Francisco, California, is considered by federal authorities as the main financial operator of the CJNG. She has dual citizenship, and is also registered [birth] in Morelia, Michoacán. She has a degree in Marketing, graduated from a Jesuit university in Guadalajara.

The eldest daughter of Nemesio Oseguera and Rosalinda González, was 22 years old when in mid-2009 she became the new owner of a property located: Playas de Tijuana. Today she is a shareholder of several companies identified by the US Treasury Department as a "front" of money laundering allegedly from illicit drug trafficking.

Messrs. Alejandro "N" and Elvia "N" sold Jessica  the lot 14 of block 108, Jardines de Playas de Tijuana, with an area of ​​300 square meters. According to the cadastral code PT-108-014, the property whose sale operation was 2 million 25 thousand pesos, borders East with Del Volcán street. This time the writing, number 64343, was prepared in the Public Notary Number 64 of Guadalajara.

However, the property of Oseguera González was also seized  in the same preliminary investigation initiated after the arrest of his uncle Abigael González Valencia on the last day of February 2015 in Puerto Vallarta. The office number PGR / UEAF / DGALF / 2207, dated July 13, 2017, instructed the RRPC of Baja California to register the record corresponding to the legal status of the property.

Claiming that she had only recently become aware, on November 21, 2018, Jessica Johanna, through her attorneys in Tijuana, filed a demand for guarantees before the First District Court on Matters of Amparo and Federal Trials with the intention of proving that he was the victim of an "illegal order of assurance and limitation of ownership in real property, and its execution".
On December 7, the promotion was accepted and became the amparo trial 1556/2018.

To date, the matter has not been resolved and the constitutional hearing has been deferred eight times due to the lack of justified reports from various responsible authorities. However, a definitive suspension of the act claimed protects the complainant so that things keep the same state they are currently in, without the property being available for sale or sale.

The lawyer Víctor Francisco "N", who accompanies the family of  "Mencho"  and members of the CJNG in the defense of their criminal proceedings, conditions of imprisonment, arrest warrants or assurances, regardless of the state where the matter is dealt with jurisdictionally , is the one who represents Jessica in the amparo trial in Tijuana.

It was learned that among those who have not responded with their report to the federal court is the Agent of the Public Ministry of the Federation attached to the Specialized Unit in Financial Analysis of the FGR based in Mexico City, so the constitutional hearing was deferred for the second week of next July.


"EL MENCHO" IN TJ

With the above background it is understood why the only amparo trial promoted by Nemesio Oseguera Cervantes "El Mencho" did so in this city of Tijuana in the first days of March 2012 before the disappeared District Court Seventh. The leader of the CJNG, under the name of Rubén Oseguera, demanded an order of apprehension turned over by a federal judge of criminal processes of the State of Jalisco.

As the arrest warrant did exist, a controversy was formed regarding the competence to resolve the trial of guarantees, since it was believed that the court order in Jalisco had been issued, in that entity the claim of the complainant should be resolved.

However, when the matter was sent as a jurisdictional dispute before the Fifth Collegiate Court of the Fifteenth Circuit, with residence in Mexicali, the magistrates unanimously decided that the amparo trial should be resolved in Tijuana, since "El Mencho" had expressed domicile in this city, which was kept sealed, but now known, was located in Playas de Tijuana.

In his letter, Oseguera Cervantes stated under protest to tell the truth - on that date - that he lived on this border and that outside his home were elements of the Attorney General's Office trying to stop him, a sufficient reason for finally the Seventh Judge of the District of Baja California to decide the amparo.

Rubén or Nemesio was granted the protection of federal justice so that an arrest warrant issued in Guadalajara for his probable responsibility in the commission of the crime of organized crime for the purpose of committing crimes against health would be rendered null and void. So ordered on August 12, 2011.

As for the  reasons that the then Seventh District Judge in Tijuana had to protect the "Mencho" the judge of the case "did not state the particular reasons or special circumstances that arrived to determine that the complainant today did the functions of administration and "Jalisco  Cartel New Generation”.
From then to date, another half dozen arrest warrants have been issued against Oseguera Cervantes, who has never filed another writ of amparo.

OTHER AMPARO

A couple of weeks ago, ZETA reported on the protection and protection of federal justice granted by a Collegiate Court of Jalisco for Rubén Oseguera González "El Menchito" that leaves without effect a formal prison imposed for the crime of organized crime. Another Collegiate Court of the same judicial circuit confirmed another amparo for Jessica Johanna Oseguera against an arrest warrant for the same crime as her brother.

A Unitary Court had already benefited Jessica in January, but when the FGR did not hear the matter, it went to the Collegiate, where the magistrates believe that the amparo was well granted due to the Federal Public Prosecutor's Office, when exercising criminal action against the "Mencho's" daughter. "
This is the same arrest warrant for which her mother was arrested in June 2018 in Zapopan, who was later released to face the process in freedom. Both were accused of organized crime for the purpose of committing the crime of operations with resources of illegal origin, indicating that they performed administrative and supervisory functions in the criminal organization.

The test data provided by the FGR is derived from a search procedure in one of the companies in Guadalajara, and  bulletins issued by the US government, where it was possible to seize  74 assets  with the accounting records of the legal entity, as well as other titles.  They also provided wiretaps obtained from the telephone intervention of Jessica Johanna and her mother.

However, the federal Public Ministry concealed that a criminal action had already been filed against both women, denying the arrest warrant by another judge, a situation that the judge of protection and the judges of the Collegiate considered as a lack of the principle of loyalty.

The amparo orders that the arrest warrant be revoked and that the investigation folder be returned to the prosecutor of the Specialized Unit in Terrorism, Stockpiling and Trafficking in Weapons (UEITA) of the FGR, who knew of the case, so that it could recompose the investigation and, to reconsider it returned to exercise the criminal action.
