El Chapo's Trial Postponed Until September

by Chivis Martinez for Borderland Beat

Surprising news came today in the U.S. case against Joaquín “El Chapo” Guzmán, The judge granted defense's request for a trial continuance.

On Monday, subsequent to defense unopposed request, the judge indicated he would make the decision in February, only two months before the scheduled trial.

Docket text on Monday:
RESCHEDULING ORDER as to Joaquin Archivaldo Guzman Loera. The Status Conference previously set for 1/19/2018 is rescheduled by the Court to 2/15/2018 at 10:00 AM in Courtroom 8D South. By 2/8/2018, the parties are to submit separately their proposed agendas for the 2/15/2018 status conference. Time is excluded under the Speedy Trial Act until 2/15/2018; case previously designated complex. Ordered by Judge Brian M. Cogan on 1/8/2018.
Not knowing if the court date would be postponed would put a hardship on the defense, however in today’s ruling the defense is granted the continuance.  They are scheduled to attend a status meeting where thy will determine the exact trial date sometime in September.
Todays’ Docket Text ruling: U.S. District Court Eastern District of New York
The following transaction was entered on 1/10/2018 at 4:58 PM EST and filed on 1/10/2018
Case Name:     USA v. Beltran-Leyva et al [this is the indictment title]Case Number: 1:09-cr-00466-BMC-RLM
ORDER granting defendant's unopposed motion as to Joaquin Archivaldo Guzman to continue trial. Because summer vacation schedules may significantly reduce the jury pool should the trial begin in August, the trial will be reset for a date in September 2018. Counsel are directed to clear their calendars for September and to come to the next status conference prepared to discuss the appropriate date in September. Ordered by Judge Brian M. Cogan on 1/10/2018.

    1. You’re stupid if you think Chino or Zambada will testify! Maybe Lics but never anyone from the Zam Clan. They will not be on anyone’s paperwork because you know who, owes you know who. Bet.

    2. 12:48 you’re a complete moron, chino and zambada already took a plea deal agreeing to testify, which is why in chino’s case he hasn’t been sentenced. If they decline to testify in any case the government calls upon, or if the US government feels they aren’t being as helpful as can be then goodbye plea deal hello life in prison. At this point those guys care about one thing, getting out

    3. 12:48...for sure...Zambadas, and Valencia's. They don't have to rat...they just buy their sentences, and unlike Damaso's, they'll have their $$$, when out.

    4. Too bad we’ll never know because the case will be sealed under the guise of National security.

    5. You think Chino will ever return to Mexico?

    6. What you failed to realize is in Vicente Zambada's PLEA DEAL he has to testify against ANYONE the US Govt bring a case against, thats why he got a super PLEA DEAL. But it wont ever get to that level, because El Chapo's John Gotti Atty Dream Team will use the same US/DEA/CIA Sinaloa Agreement Vicente used against the US to expose the US partnership with the Sinaloa Cartel to secure El Chapo's Sweet GET OUT OF JAIL FREE CARD with a major CASH FINE of coarse PAID to the GREEDY US Govt for the sweet deal and their future job promotions. smh. By the way, I talk to El Mochomo and have 4 US Atty's working on his appeal because he said FU US, I WILL NOT PAY $10B on a bogus indictment used against his brother in Chicago with the Flores Brothers. Oh, I almost forgot, the Flores Brothers who recorded El Mayo & El Chapo meetings while wearing a wire, will testify as they been doing against ALL Sinaloa Businessmen being extradited to the US. The US Govt flys them in and out.

    7. @10:53 that’s the point! That’s why I stand by my theory that anyone associated with Z Clan is not testifying or on paperwork. VZ spoke to what his dad does, he didn’t enlighten anyone, the only bomb he dropped was putting the US gov on front street and asking for his AIC handlers to testify for him. He’s a smart dude, I believe he did it as slight for them not blocking his extradition. His other mistake was speaking to JT relationship w/ his family and mentioning that shootout where an office died. He shouldn’t have spoke to that but he get a whooping for that and he’ll take it like a man.

The real rats are the Flores Twins. Point blank they are the reason the dominoes fell the way they did.

Or they may be the patsies, maybe The Federation was too big and dismantled by its handlers, that’s a possibility.

      Don’t do drugs.

    8. 10:00 am it doesn’t take much to find info to show that many people affiliated with “Z” are on paperwork as agreeing to become government witnesses. The bottom line is if they are currently locked up, they will do anything that is asked of them, the government can at anytime take back their plea deals and impose full sentences or they can lower a sentence like they did for Arellano after his complete cooperation, so you’re just plain wrong

    9. El Mayo did not deal with the twins, Vicente zambada niebla his son did, but pleading guilty doesn't mean ratting on anyone.
The only reason the Mexican cartels are getting put down is because new Mexicans in government want their cut, they are all military or federal police former military and it better be a big cut worth their while. That the idea behind "Mando Unico", let the facking police and melitany go get paid to support a corrupt Mexican government that can't pay them.

    7. Vicente Carillo Leyva son of Amado studied in switzerland?
I'm wondering because Kim Young Un the emperor of the hermit kingdom of North Korea studied there and has aunts living there, and some Mexican politicians kids are there, and North Korea had an embassy in mexico that Videgaray ordered to leave the country and went to Cuba, and NK has a lot of friends in france, Russia , China and possibly more.

  6. The more he postpones his trial the more the palm of his hand is going to grow hair. At least once he gets sentenced these restrictions of him not seeing anyone might end.
This is of course a strategy so that he can continue to play the loosing his mind trick and can perhaps be sentenced to a mental institute after the trial instead of a maximum security prison. If the U.S. judge, jury and others would buy this shit this would mean a definite win for Chapo and or show that even the U.S. is corruptable. What a disgrace!

    1. He’s not walking. This is the United States, not Third World Mehico.

    2. He can walk on violations of his basic rights violated in the judicial system here in the US. Ive never heard of anyone getting restrictions to family/friends, lawyers and witness names being withheld in such a big case or the violations to his health by keeping him segregated 24/7 in a county jail/pretrial setting. The justice department is basically tying to sabotage this case..

    3. I'm.starting to agree...something doesn't add up. Either he REALLY does have some real dirt, on a Big Shot, or they're trying to kill him with his isolation, or it'll be a "Suicide". Either way he never goes free. As of now, I doubt there will be a trial.

  9. He's a monkey wrench stuck in a great big machine and he's caused some damage and it'll take a good long time for the gears to grind him to powder.

  10. This guy is playing the system, he will convince the jury that he has lost his mind due to the restrictions enforced on him... instead of ADX he will be held in a mental institute where the possibility of an escape is far more feasible than ADX. Mark my words.
