Federal Judge emits a "favourable opinion" for the extradition of "El Chapo" Guzman to the United States

The Council of the Federal Judiciary detailed that Jaoquin Guzman Loera is subject to " the fourth process supervening CR 95-0973-B, also referred to with the cause numbers 95-973-B, 95-0973-B and 95-1911M, before the Federal District Court, of South California, United States of  America, for the charge of criminal association in order to import and posses with the intent to distribute cocaine".

A Federal Judge emitted a " favourable opinion" for the extradition to the United States of Joaquin Guzman Loera "El Chapo".

A Council of the National Judiciary detailed, in a communication, that " a Judge of the Third District of Penal Processes in the City of Mexico, in the extradition proceeding 3/2001, that the opinion of the Judiciary, in relation to article 27 of International Extradition Law, is to proceed with the international extradition of Joaquin Guzman Loera, as required by the Government of the United States of America, from their Mexican Embassy.




The Council of the Federal Judiciary detailed that Jaoquin Guzman Loera is subject to " the fourth process supervening CR 95-0973-B, also referred to with the cause numbers 95-973-B, 95-0973-B and 95-1911M, before the Federal District Court, of South California, United States of  America, for the charge of criminal association in order to import and posses with the intent to distribute cocaine".

The Council of the Judiciary had said the former, "in virtue of considering complete, the established requisites in the extradition treaty agreed between the United States of Mexico and the United States of America".

The Secretary of Exterior Relations now has 20 days to determine if to grant the extradition, or not, of Guzman. The capo's defense team can promote an amparo judgment to challenge his move, this could postpone by weeks or months, the transfer of the capo to United States authorities.

Guzman first was notified of the determination of the Judge on Sunday night, the associated press was told that a judicial authority, who he was not authorized to identify because of internal policies, prevent you from giving details of processes that are in course.

Guzman, considered  the leader of the Sinaloa Cartel, was suddenly transferred on Saturday from the maximum security prison "Altiplano" to Juarez Cefereso #9 closer to the border with the United States, even though the Government has said that he was not moved due to the extradition process, but because of measures to upgrade the security of "Altiplano".

Guzman's lawyer, Jose Refugio Rodriguez, said to the AP that the Government would seek to hide his extradition, "that is their legal strategy", he commented via telephone. He also said that once the Foreign Ministry resolved the extradition, the defense has 30 days to promote the amparo.

Also, Rodriguez said that they will seek to have Guzman returned to "Altiplano", under the argument that the transfer at the weekend affects his proper defense, in due course, because the Judge who is dealing with their process is not near the prison where the capo is now being held.

Guzman Loera was transferred from "Altiplano", in the State of Mexico, to the Federal prison in Ciudad Juarez, Chihuahua, on the morning of this Saturday passed, " as part of the security strategy implemented in September", in that they have rotated more than 7,400 inmates in all of the country, according to the Secretary of the Government.

Yesterday, El Chapo's lawyer, Andres Granados said to Univision, that the day of the transfer the capo didn't understand what was happening, nobody had given him an explanation. His only thought was that the day of his extradition to the United States had finally arrived.

" I thought that I was going to go and eat hamburgers", Joaquin Guzman Loera jokingly said on Sunday to Andres Granados.

Granados related the conversation that he had with his client, Guzman Loera, after being transferred to the Ciudad Juarez prison: " he said to me that they arrived in the morning, and that they said to him " we are going to get revenge here". They took him from his cell, they handcuffed him and took him away. When they were leaving he heard the helicopters and he said to himself " now I will be extradited". Until he arrived here, first at Ciudad Juarez Airport and then a transfer to Cefereso #9".

  2. Either Chapo was dumb - allowing himself to be caught and in prison staring at the wall - after having escaped or a deal was made for his family and some of his fortune. I would think he'll hide in the mountains.
    There is also something fishy about Zambada's kids being arrested - one caught with weed from California? He did not have minders?

  14. Otis, can you help me understand why Chapo's attorney Refugio Rodriguez is seeking to get his client returned to the same prison where he was being turned into a zombie?

    Wouldn't all prison's take the same security measures as Altiplano (sleep deprivation, changing cells every 2 hours, noise, etc.)?

    An amparo can take months or years and the article states the judge handling the process is not close to Juarez. Is that a legitimate reason to seek to get Chapo back to Altiplano, or is their clients life really in danger in Juarez by a rival cartel as some comments here have speculated?

    1. At this moment, Chapo's lawyers are trying anything they can to throw a spanner in the works. How long an amparo takes depends on what amparo of the 5 types there are, that has been promoted.

      The judge who emitted the favourable opinion has a base in Toluca.They are saying that this is too far from Juarez, for his lawyers to do anything at short notice.

      His lawyer in the article claims the government are trying to hide his extradition. If he is close to the border, if they just arrive at the prison, to take him to the USA, its a 30 second flight to get into USA from Juarez, that gives the lawyers next to no time to launch any legal objection. If he is being held at "Altiplano", it would take much longer to get him from there to USA soil, giving his lawyers a much needed few hours to try a legal last ditch attempt to stop him being extradited on the day

  17. A U.S. politician is stating that Chapo might be extradited to the U.S. around the end of 2016 at the earliest. My question is to the Mexican government if they really do intend to protect this idiot Chapo with 200 or more Federales and Soldiers during Chapos stay in Juarez wasting all these resources on this one stupid thug? Chapo has more security personell in this prison than the Mexican President has in his entire staff! What Fuckin nonsense!

  22. I posted in BB el Chapo will never step on soil of USA by extradition. I also said to a group in Aug 2015 that Trump would never be elected, and I told my friends in São Paulo last February that Rousseff would never be impeached. I am not happy about the Trump situation but in each of these situations it shows a changing world. A world where citizens are being empowered and saying no more free pass to cheat, steal and lie for the elite. It should also be noted that Nigeria which is the most corrupt country I have regularly attended elected Pres Buhari whose only campaign premise is to fight corruption and my cohorts of Nigeria believe him. I have big hope that the future brings less corruption throughout the world and that people instead of only the powerful will be heard.

  25. Its the perfect place to keep chapo. Ot makes.for a quick extradition and it adds alot of pressure to chapo in terms of danger from the juarez cartel that want and can have him killed. At this rate I think chapo is shiting bricks and would rather bounce to the US.
