Atty files for "El Mochomo" trial delay, discovers new evidence

And it begins…. but then again, maybe not quite yet.  The Washington D.C. trial of Alfredo ‘El Mochomo’ Beltran Leyva, is scheduled to begin on February 16th.  However, last Friday, his attorney Mr. Eduardo Balarezo, filed a motion for a 90 day delay of trial.

In the motion,   it revealed the reason for the delay request:

“Mr. Beltrán Leyva became aware of evidence located outside of the United States that has a direct bearing on the credibility of several of the government’s cooperating witnesses, whom the government named just this week.

A prosecution that is principally based on cooperator testimony, such evidence is material and crucial to the defense of the charges.

Mr. Beltrán Leyva cannot proceed to trial without being able to obtain the evidence and use it in his defense. Counsel has made an ex parte proffer to the Court pertaining to the nature of the evidence. Considering that the evidence is outside the United States and efforts must be made to obtain it in time for trial, Mr. Beltrán Leyva respectfully requests a 90-day continuance of trial.”

Motion granted:


FURTHER ORDERED that the Jury Trial presently scheduled for Tuesday, February 16, 2016, at 10:00 AM is vacated, and will be rescheduled to and date and time to be determined. SO ORDERED. By Judge Richard J. Leon

I always wonder do people just hate chapo or do they just hate his level of notoriety or are they supporters ,wannabes of other less successful cartels.     1. Juan dos cabezas y ninguna te sirve. El Mochomo esta en EEUU. Ya no hay mas quebrada ni sicarios por aqui ni mucho menos alguien que se atreva a matar un juez norteamericano. Su gente no tiene el poder ni los números para controlar ejecuciones a altos niveles del sistema judicial. En México todavía es posible pero aún los juezes tienen mucho poder y protección y no los matan. El Mochomo quedará en prisión por decadas. No habrá opción de salir.

  9. The evidence isn't evidence. It's leverage against some of the witnesses. Maybe a kidnapped family member or severed heads. After all the "evidence" is in Mexico and we all know anything goes in Mexico. It will be interesting to see what it is. I believe it will be something that will turn the tide in Mochomo's favor. It would be the bomb if it was El Chapo making amends to his primo and testifying in his favor.

    12. BLO did have direct connections to Colobian, Peruvian and Bolivian cocaine. Sinaloa and other cartels did purchase their supplies from BLO initially. However, as time had gone on, everyone of the groups had their own contact. By the way, BLO, Sinaloa and all these cartels come from the same root.   16. I have news on Broly Banderas. He was snuffed by his superiors. His body is buried at a ranch known for lime production in Michoacán. My source does not know why Broly was killed but just said he overheard a group of men talking and one said "he knew too much. It had to be done." My source said one of the farmers who witnessed the assassination was handed Broly's belongings, including a wad of pesos and US money. The BLO had a hit list of witnesses and their family members in US and Mexico. Don't know the credibility of it, but there are chatters going on with this due to the pending trial.

    2. Thank you Chivis. Aside from the various nefarious reasons for an extension, there are many legitimate legal reasons to demand more information. Due to DOJ, et.al shenanigans with respect to collaborating witnesses, a proper defense must tease out bogus Glomar defenses, etc. and be prepared to vigorously impeach the testimony of "collaborating witnesses."

I think that somewhat normal for DEA operations this thing with CDS and US government sanctioned immunity.It happened in the 80's with Noreiga.These cartels believe what they are told[maybe they have no choice in 'the deal'].Noreiga was promised he could operate with impunity with the CIA planes if he could set up Columbians for them to bust.It worked for awhile and hey all the Columbians wanted to go through Noreiga[never lost a load].When Noreiga started not cooperating as much as they wanted,well they nailed him but I think they would have done that anyway when his usefulness expired.I think exactly the same thing is happening now with CDS.They were allowed to operate freely for 10 years now their contract is up,they just didn't know it.
