Ruling: Vicente Zambada-Niebla Did Not Prove He Was an Informant

A federal judge in Chicago refused Thursday to dismiss charges against a reputed Mexican drug kingpin who claimed he was working as an informant for the government.  Vicente Zambada-Niebla failed to provide evidence to rebut the government’s contention that he was never granted immunity from prosecution on drug-trafficking charges, U.S. District Judge Ruben Castillo found.
Zambada-Niebla is the highest-ranking reputed member of the Sinaloa cartel in U.S. custody in a case being tried in Chicago against members of the drug-trafficking organization which authorities say is headed by Joaquin “Chapo” Guzman, described by the U.S. Treasury Department as the “world’s most powerful drug trafficker.”
Castillo’s written ruling offers a glimpse into the secret workings of the U.S. Drug Enforcement Administration in Mexico.
According to the judge’s ruling, Sinaloa cartel lawyer Humberto Loya-Castro was a confidant to Guzman and right-hand man Ismael Zambada-Garcia, who is Zambada-Niebla’s father.
After Loya-Castro was charged in a narcotics case in California in 1995, he started providing information to DEA agents about Mexican drug trafficking. The case against Loya-Castro was dismissed in 2008 at the request of prosecutors.

In 2008, he proposed a meeting between his DEA contact and Zambada-Niebla. On March 17, 2009, they met with DEA agents at a hotel in Mexico City. Hours later, Zambada-Niebla was arrested by Mexican officials.
Prosecutors say Loya-Castro brought Zambada-Niebla to meet DEA agents at the hotel against the agents’ instructions.
“According to the government, [Zambada-Niebla] conveyed his interest and willingness to cooperate with the U.S. government, but the DEA agents told him they ‘were not authorized to meet with him, much less have substantive discussions with him,’ ” the judge wrote.
Zambada-Niebla argued that Loya-Castro had negotiated an immunity deal for him; that he provided information to Loya-Castro about rival cartels that was then passed on to the U.S. government; and that he traveled to Mexico City at great risk to himself for the meeting with DEA agents because he was assured he had immunity from prosecution.
The judge said Zambada-Niebla didn’t present enough evidence to refute the government’s position that he was never granted immunity.
Last year, Zambada-Niebla was moved from the federal lockup in Chicago to a prison in Michigan after complaining about conditions in the Chicago lockup. Federal authorities were concerned he was an escape risk and potential assassination target.
 
In an unrelated drug-trafficking case in Chicago last year, a defendant testified that he met Zambada-Niebla in the federal lockup here and that Zambada-Niebla sought information to have two co-defendants killed. Those defendants — Chicago natives Pedro and Margarito Flores — are cooperating with prosecutors in the case against Zambada-Niebla, court records show.

  18. He couldn't prove his innocense because the US didn't want to release documents that backup his argument. The argument used by the us is " we cannot release the documents because it would be a threat to national security" so i dobg think he couldn't prove he just didn't have a proper trial. Im a criminologist and not just speculating. I've been following those case and i can say great job at covering up your fuck ups usa.

  28. It was his duty to have documentation that support HIS claims, and his lawyer would have added it to the evidence when both sides went into 'discovery'.
    Anything would have worked: a letter containing some kind of tip, a recorded conversation between at least one agent, or simply paying an agent to say that he was the one responsible for xyz tip where -noun- was captured.

    T.L.D.R version: It's not in the prosecuter's interest to aid the defense... in ANY case. That's why one is given the option of at least having a lawyer appointed to represent them.

    Vicente Zambada should have kept records...he didn't, and now he should pay. It's similar to me wanting to return an item to Target and forgetting my receipt. If I tell them that the store managers have surveillance film showing that I indeed did buy the item in question, it's not their duty to prove that. It's also not worthy to mention the cashier that rang my purchase on that day, because who he or she could be a family memb, or a friend and be only helping me-there's no concrete piece of evidence. I would not be allowed to return my item-except for maybe a gift card.

    In the end, V.Zambada wasn't allowed to return his ''item,'' but will be given a ''gift card'' for a few years off the prison sentence.

  36. One would imagine that in a state of failure, such as the one v.Z is in, would grant the defendant hundreds of years in prison.
    It has been my observation that states a relationship among the population when their life's future is pending. Some claim insanity, some claim an unjust trial, while others claim pampering of the evidence. All of these, or at least one, are used to allow more time in ''discovery''. The defense can divide the task while this is going on. One member from v.Z's team can allege the informant idea, while the rest are ''mining for gold.''

  37. There are many prisoners that'll protect v.Z while in prison. He has some of the biggest ties to most of the drugs now considered standard. The only issue I can see involves the location that he'll be surving time. v.Z would only need to watch out for rival prison gangs such as the H.P.Latinos, and the northerners of Cali 13.

    I'm not a fan of the Sinaloa Craple -yes on purpose- but imagine that he'll be able to charm enough female or male prison guards and with the help of 25M+ each...be able to plan an escape with ease.

I find it ironic that some commenters on here have disdain for the US gov't but not for the drug king pins, who are the real culprits. As far as the US lying or using deceiving practices to infiltrate DTO's...well WTF do you think is supposed to happen. An undercover operation in itself is a farce, a lie designed to gain the trust of those criminals inside the organization! Just like the US Federal Law Enforcement agencies, like the DEA...actually buy drug shipments through CI's from cartels, in an effort to establish evidence of the crime (suppliers and key players in the business). There is no other way..these cases take months/years to establish but the ending result is usually an "iron clad" case against the offenders, who in turn accept plea deals...offering inside detail information about DTO's. Bottom line all top cartel bosses are snitches...especially those who get caught. There is an old saying "there is no honor among thieves!" For those of you, who think DTO's are made up of secretive...honorable men, you are ignorant! Chapo, Lazcano, Mayo, EL Cos, and others would "sell out" their own mothers, if it meant escaping American justice and keeping their fortunes alive.

    And for the ass clown, who thinks the Sinaloa cartel is going to seek revenge against the DEA because of Zambada-Niebla's troubles in US courts...lol, your funny! I got news for you, as far as Chapo and Mayo are concerned he's already forgotten about!
